The Western Surface Agreement of 1987 of the International Union of United Mine Workers of
<br />America also requires annual retraining of miners in the instruction of fire warning signs and •
<br />firefighting procedures.
<br />Seneca Coal Company is in compliance with and conducts all required MSHA and UMWA courses as
<br />stated in the law and contract, respectively.
<br />Health and Safety
<br />The Yoast Mine facility falls under the Federal Mine Safety and Health Act of 1977, PL 95-164. The
<br />Mine Safety and Health Administration, the enforcement agency, is a part of the U.S. Department of
<br />Lahor. MSHA is required to inspect and enforce the Code of Federal Regulations Title 30, which
<br />includes Parts 48, 50, 71 and 77.
<br />Part 48 sets forth the requirements for obtaining approval of training programs and specifies the type
<br />of training including new employee orientation for non-experienced miners, orientation of newly
<br />employed experienced miners, annual refresher course for all miners, hazard training for non-employees
<br />coming onto mine property, and task training for employees who are assigned new jobs temporarily.
<br />Part 50 requires operators to file reports pertaining to accidents, occupational injuries and occupational •
<br />illnesses, as well as employment and coal production data, with MSHA, and requires operators to
<br />maintain copies of reports at relevant mine offices. The purpose of this Part is to implement MSHA's
<br />authority to investigate, and to obtain and utilize information pertaining to accidents, injuries, and
<br />illnesses occurring and originating in mines.
<br />Part 71 of CFR 30 sets forth standards for dust, noise, sanitary toilet facilities, change rooms, sanitary
<br />toilet facilities at surface work areas, and drinking water. 'These standards are spelled out in terms of
<br />the concentration of respirable dust to which a miner can be exposed and the general requirements for
<br />noise level exposure. The size, location, and number of the change rooms, sanitary flush toilets,
<br />portable toilets, showers, hand lavatories, and lockers are: based on the number of employees. An
<br />adequate supply of drinking water and cups shall be providf:d in marked disinfected containers.
<br />Part 77 deals with the mandatory safety standards. This Part is divided into 20 subparts with sections
<br />under each subpart. The subparts listed are Qualified and Certified Persons, Surface Installations,
<br />Thermal Dryers, Safeguards for Mechanical Equipment, Electrical Equipment-General, Training Cables,
<br />Grounding, Surface High-Voltage Distribution, Low and Medium-Voltage Alternating Current Circuits,
<br />Ground Control, Fire Protection, Maps, Explosives and Blasting, Man Hoisting, Auger Mining, Loading
<br />and Haulage, Miscellaneous, Trolley Wires and Trolley Feeder Wires, Slope and Shaft Sinking, and
<br />Approved Books and Records. •
