~~6. Exhibit D states that 'the following procedure for reclamation is based on general
recommendations by the Soil Conservation Service and recommendations specific to this
property.." Please provide a copy of the recommendations. By the way, the SCS changed their
name to the Natural Resources Conservation Services (NRCS).
7. The financial warranty requirement is based on anticipated disturbances within the affected
land area. For Limited Impact 110 permits, the entire permit area is considered to be affected
land since it is neazly impossible not to redisturb reclaimed areas within a small sized permit.
Except for the access road, the entire 9.12 acre pit area will need to be reclaimed. So, therefore,
the financial warranty requirement must be based on the expected disturbances within the permit
area. The operator can reduce the bond by requesting a release of those areas which have been
reclaimed (as soon as they meet the reclamation requirements). The financial warranty
requirement will need to be revised.
h Prior to approval of the permit application, the applicant must submit proof of notice to the
.)'x~' adjoining landowners (within 200 feet of the permit azea) pursuant to the requirements of Rule
1.6.2(1)(g).
Please be advised that the permit application may be deemed inadequate, and your application
may be denied on September 14, 2000, unless the above noted adequacy items are addressed to
the satisfaction of the Division. If you find you need additional time to address the above
adequacy items, submit a request [o extend the decision due date. You can extend the decision
date up to 365 days from the submittal date. An extension request must be received by September
14, 2000.
If you have any questions, please give me a call.
Sincerely,
CC1zA, ~~
James Dillie
Environmental Protection Specialist
cc: James Stevens, DMG
Mazilyn E.
