In order to meet <br />the minimum requirements of the AcV Rules and Regulations the following items must be <br />addressed: <br />1. The permit application form stipulates only 9.12 acres are to be permitted. However, the <br />exhibits show an affected area consisting of a 9.12 acre pit and a 0.49 acre access road. This <br />equals 9.61 acres. Page one of the application form must be revised to reflect the correct amount <br />of affected lands. You are correct to include the access road in the permit area since the operator <br />intends to upgrade and maintain the existing road, pursuant to Rule 6.3.3(8), even though the <br />road will remain unreclaimed at the end of mining operations. <br />fl 2.}'ou stipulate in Exhibit B that there are no man-made structures within 200 feet of the <br />- fZ~1G~ permit azea. This implies the proposed permit area lies in an open range area; no fences. If true, <br />the permit azea may need to be fenced after mining ceases in order to prevent grazing. <br />~~I'he submittal stipulates that the access road is existing but will be upgraded and <br />matntained. Please describe in detail how the road will be upgraded and maintained. <br />4~. ,f groundwater is encountered the operator will need to comply with Colorado water laws <br />or backfill the areas which have encountered water. The operator needs to commit to completing <br />one of these remediation requirements. <br />5. The operator proposes to leave 2:1 sideslopes. Pursuant to Rule 6.3.4(1)(6), if the applicant <br />proposes slopes steeper than 3:1 the applicant must include a justification that supports steeper <br />slopes for the proposed post-mining land use, and demonstrates compliance with the applicable <br />performance standazds of Section 3.1. <br /> <br />STATE OF COLORADO <br />
