It is assumed that this <br />area is part or all of the 12 acre previously disturbed area. Either label this area on the <br />map or show the symbol in the le;end. <br />Exhibit D - Minine Plan <br />The mining plan states that "the excavation will be performed in the naturally occurring <br />groundwater table with no de-watering of the pit azea." A copy of the Substitute Supply <br />Plan filed with the State Engineer's office is included with the application. That plan <br />indicates that de-watering will occur. Please explain this apparent discrepancy. Will <br />excavation actually take place below the water table using a dragline as indicated in this <br />application or will the pit be de-watered? <br />2. Your application as presently written includes mining through the area of a drain ditch at <br />the boundary between Phase 4 and ~. Ed Kite, Manager of All Rite Paving and Redi- <br />Mix and Robert B. Laird of Banks and Gesso, LLC have stated to the Division that <br />mining disturbances will not encroach closer than 200 feet either side of the ditch. <br />Please provide the necessary changes to your application. <br />What is the nature of the stratum immediately beneath the material to be mined? Rule <br />6.4.4(f)(ii). <br />Your application includes the operation of an asphalt batch plant. Provide your plans for <br />containing and disposing of spills of Petro chemical products. If fueling operations and <br />other equipment uses of Petro chemicals are anticipated in the permit area, provide spill <br />containment and disposal plans for spills of such products. Spill containment facilities <br />should have the capacity to contain 125% of the volume of the largest storage tank that <br />could spill to that facility. <br />Exhibit E -Reclamation Plan <br />Your mining and reclamation plans state that 2.5 feet of topsoil overburden will be <br />salvaged and stockpiled for reclamation. There is a high water table and salty soils in <br />the permit area. The Rules state that topsoil and overburden should be salvaged and <br />stockpiled separately. Provide your plan for salvaging, stockpiling and using in <br />reclamation the best l8 inches of topsoil or other growth medium available for <br />reclamation of the lake bank slopes. <br />2. In one place your application states that 18 inches is the maximum depth of topsoil <br />replacement.
