• outlining the planned water use/rights transfer and request approval. <br />Upon receipt of all necessary permit approvals from both the State <br />Engineer and the CMLRD, EFCI would complete the water rights transfer and <br />the Corely Company would assume primary responsibility and liability for <br />water use, consequent impacts, and any eventual abandonment of the well. <br />4.05.15 WATER RIGHTS AND REPLACEMENT <br />As discussed in Sections 2.04.7, Hydrology Description, and 2.05.6, <br />Mitigation of Surface Coal Mining Operation Impacts, EFCI's mining and <br />related operations are not expected to adversely impact any surface or <br />groundwater rights. Consequently, there is no need to address provisions <br />for replacement of impacted water rights. <br />EFCI currently has the legal right to utilize water from the Corely Mine <br />Well for mining, processing, and related operations. With consumptive use <br />from this well for a period of over ten (10) years, there is no evidence <br />• of any reduction in flows or depletion of the associated groundwater <br />reservoir. Therefore no adverse impacts are anticipated. However, as <br />discussed in Sections 2.05.6, Mitigation of Surface Coal Mining Operation <br />Impacts, and 4.05.14, Transfer of Wells, EFCI could transfer water rights <br />from the Corley Mine Well to the existing mine dewatering well in order <br />to ensure a reliable long-term source of water in the unlikely event that <br />the Corley Mine Well is impacted. <br />4.05.16 DISCHARGE OF WATER INTO AN UNDERGROUND MINE <br />Water will not be diverted or discharged into any underground mine in <br />conjunction with ongoing mining and reclamation operations at the <br />Southfield Mine. All temporary and permanent diversions within the <br />Southfield Mine and loadout areas have been designed to maintain effective <br />flow under all anticipated conditions. While underground mining <br />operations may result in some ground subsidence, surface subsidence will <br />be limited as discussed in Section 2.05.6, Mitigation of Surface Coal <br />• Mining Operation Impacts, and should not result in any alteration of <br />surface flow patterns or drainage of surface water flows into underground <br />mine workings.
