EFCI to evaluate and determine the success of mine plans, drainage and sediment <br />control facilities, and reclamation for the purpose of minimizing disturbance to the <br />hydrologic balance and assuring the success of proposed post-mining land uses. <br />Monitoring data collected over the water year is submitted to the Division in <br />accordance with Exhibit 25, Hydrologic Monitoring Plan. Since EFCI reports <br />discharges in accordance with its NPDES report filings on a quarterly basis, EFCI <br />will notify the Division of NPDES report filings in compliance with Part <br />4.05.13(2)(ii)(b). EFCI will also notify the Division of any possible non-complying <br />discharges within five (5) days of receiving analytical results indicating possible <br />non-compliance. If non-compliance with a NPDES permit effluent limitation does <br />occur, EFCI will forward the analytical results concurrently with the written <br />notification of non-compliance. <br />EFCI will continue surface and groundwater monitoring activities after completion <br />of reclamation operations to document restoration of pre-mining hydrologic <br />characteristics. Monitoring will be discontinued when untreated surface runoff <br />meets applicable effluent limitations and the Division approves removal of drainage <br />and sediment control structures. <br />4.05.14 TRANSFER OF WELLS <br />EFCI currently has no plans to transfer any exploration boreholes or monitoring <br />wells for subsequent use as water wells. However, as noted in Sections 2.04.7, <br />Hydrologic Information and 2.05.6, Mitigation of Surface Coal Mining Operation <br />Impacts, the possibility exists for future conversion and transfer of the former mine <br />dewatering well (North Well) in the unlikely event that ongoing consumptive use <br />from the Corley Mine Well results in depletion of the associated groundwater <br />reservoir. <br />If it becomes necessary to replace the Corley Mine Well water right, EFCI will <br />submit the appropriate applications to the State Engineer for a well permit and <br />transfer of water rights prior to initiation of beneficial use from the North Well. In <br />addition, EFCI, in cooperation with the Corley Company will develop and submit <br />a written request to the Division ' <br />4.05-26 Revised 9nv97 ~. <br />Minor Revision No. 34 <br />
