<br />The Applicant states in Section C-1.1 located on page 16, that it intends to expand <br />mazketing in order to increase interest in the [ours. The Applicant also states that the No. <br />2 Tunnel has been rehabilitated in anticipation of larger tour groups and that it plans to <br />expand the tour into more areas of the mine as such areas become rehabilitated and safe. <br />The County approval for mine tours as set forth in Resolution 94-110 cleazly states that <br />such approval is for no more than 500 people per year. Thus the Applicant has approval <br />for tour operations equaling 500 people per yeaz and any tour operations in excess of that <br />number must be reviewed and approved by Pitkin County's Special Review process. <br />Thus, the Applicant does not have a permit required by Pitkin County to expand the tour <br />operations as proposed. <br />The Applicant's current mine plan as discussed in section C-3.0-Mine Plan - is <br />consistent with the current County approval set forth in BOCC Resolution 94-110. The <br />Applicant makes the representation that mining activity will expand beyond this level <br />when the economics are conducive to such an expansion. Should this mining activity <br />expand beyond the nominal mine rehabilitation, development and exploration referred to <br />in section C-3.0, the Applicant will be required to apply for a Special Use Permit <br />pursuant to the Pitkin County Land Use Code. <br />Any construction or development as presented in Section C-3.3-Master Plan- will <br />also be subject to Special Review process. This is also true for the construction of a new <br />watchman's quarter. Should a new watchman's quarters be approved by Pitkin Countys, <br />the existing quarters shall removed upon issuance of a Certificate of Occupancy for the <br />new watchman's quarters. Should the new watchman's quarters be denied in the Special <br />Review process, the existing watchman's quarters shall be removed 12 months from the <br />date referenced on the Special Review Resolution. <br />I have attached a copy of the Board of County Commissioners Resolution No. 94- <br />1 10 for your reference.
