~J <br />• <br />~J <br />1.4 PERTINENT REGULATIONS <br />The regulations of the Colorado Mined Land Rec- <br />lamation Board (CMLRB) are applicable to all surface <br />operations and facilities related to coal mining in Colo- <br />rado. All new structures must be constructed in accordance <br />with the performance standards of these regulations. <br />Existing structures and facilities are not addressed <br />directly in the regulations. Any alterations or modifications <br />to existing facilities should be designed to bring the modi- <br />fied structure into conformity with the regulations. However, <br />existing structures which precede the regulations are con- <br />sidered on a case by case basis and need not always meet <br />existing regulatory requirements. There are no regulations <br />covering specifically the types of fill on which the CWI <br />facilities are located. <br />Reclaimed cuts and fills at the site where the <br />ground slopes at less than 20° will be required to meet the <br />requirements of Section 4.14 of the regulations, Backfill- <br />ing and Grading. Reclamation on slopes steeper than 20° will <br />need to meet the provisions of Section 4.27, Operations on <br />Steep Slopes. <br />If the content of coal in the proposed waste pile is <br />sufficiently high to make the pile combustible, the pile <br />would probably be classified as a coal processing wastr_ <br />bank and so ~.aould be required t.o satisfy the pertinent <br />portions of Section 4.10 of the regulations. <br />- 4 - <br />GEONYDRO CONSULTING, INC. <br />
