~J
•
~J
1.4 PERTINENT REGULATIONS
The regulations of the Colorado Mined Land Rec-
lamation Board (CMLRB) are applicable to all surface
operations and facilities related to coal mining in Colo-
rado. All new structures must be constructed in accordance
with the performance standards of these regulations.
Existing structures and facilities are not addressed
directly in the regulations. Any alterations or modifications
to existing facilities should be designed to bring the modi-
fied structure into conformity with the regulations. However,
existing structures which precede the regulations are con-
sidered on a case by case basis and need not always meet
existing regulatory requirements. There are no regulations
covering specifically the types of fill on which the CWI
facilities are located.
Reclaimed cuts and fills at the site where the
ground slopes at less than 20° will be required to meet the
requirements of Section 4.14 of the regulations, Backfill-
ing and Grading. Reclamation on slopes steeper than 20° will
need to meet the provisions of Section 4.27, Operations on
Steep Slopes.
If the content of coal in the proposed waste pile is
sufficiently high to make the pile combustible, the pile
would probably be classified as a coal processing wastr_
bank and so ~.aould be required t.o satisfy the pertinent
portions of Section 4.10 of the regulations.
- 4 -
GEONYDRO CONSULTING, INC.
