APPLICATION OF CENTRAL AGGREGATES, MC <br />Caze No. 03 CW 290 <br />Ruling of Referee <br />Page 5 <br />b. Case: Case No. 87CW283, District Court, Water Division No. 5. <br />c. Legal description of point of diversion or place of storage: The dam is located in <br />the SEl/4 of the NEl/4 of Section 25, Township 2 North, Range 81 West of the 6'" <br />P.M.. The intersection of the dam axis with the right abutment will occur at a point <br />which bears W. 54° 54" 20" E. a distance of 3, 716.46 feet from the NE Corner of <br />Section 25. <br />d. Amount: 59,993 AF conditional; of this amount, 32,986 AF were made absolute <br />forpiscatorial and recreational uses by decree entered in Case No. 95CW251, and the <br />full amount was made absolute for all purposes by decree entered in Case No. <br />02CW 107. <br />e. Appropriation date: December 14, 1987. <br />f Decreed and historic use: All beneficial uses, including, but not limited to, <br />domestic, municipal, agricultural and recreational uses, which uses satisfy the <br />requirements of the Windy Gap Settlement made with the Municipal Subdistrict of <br />the Northern Colorado Water Conservancy District; use to meet the water <br />requirements of the inhabitants of the River District for all uses, including uses in the <br />Middle Park area, and to meet the terms of a lease agreement executed March 3,1987 <br />between Colorado River Water Conservancy District (CRWCD) and the City and <br />County of Denver. <br />C. Statement of plan for augmentation: Applicant will use both its water rights from <br />the Pioneer Ditch and its water rights from Wolford Mountain Reservoir contracted <br />through CRWCD for augmentation . The plan for augmentation consists ofreplacing <br />out-of-priority evaporation with consumptive use credits from dry-up under the <br />Pioneer Ditch and by reservoir releases from Wolford Mountain Reservoir under <br />contract with CRWCD. Exhibit 4 shows the augmentation schedule. Consumptive <br />use credits are used to directly offset evaporation by bypassing the ditch flows to the <br />Colorado River. In periods when evaporation exceeds consumptive use credits, such <br />as July through October, augmentation water will be released from Wolford <br />Mountain Reservoir in an amount equal to depletion plus 10% for transit losses. <br />Applicant recognizes that such transit losses may be modified in the future pursuant <br />to C.R.S.§ 37-80-10(7) and C.R.S. § 37-83-104. No augmentation is provided for <br />the period of November 1 through April 15 on the basis that there have been no <br />historic calls during that period on the Colorado River below the site. <br />D. Once this Augmentation Plan is decreed, Applicant shall abandon the plan of <br />augmentation for the West Rifle Pit previously decreed in Case No. 90CW 150. <br />
