The capacity of pond 9-P2 is reported as 7.67 a~~re feet on Drawing <br />Number IV-36A, 06/02/94. The capacity is determined as 2.1 acre feet on page 101 of Exhibit <br />18. Please reconcile the differences with revised pages as may be appropriate. <br />Item 46. Rule 4.05.6(11)(d). The Division has been unable to recover "Exhibit G", as referenced <br />on Drawing IV-36 for ponds 9-P1, 9-P2, and 9-P3, or other approved (Division) compaction <br />specifications as required by Rule 4.05.6(11)(d). Please assist the Divisio~a in finding the <br />construction specifications for sedimentation ponds by reference to the appropriate pages, or <br />restore the information in the Permit by revised pages. <br />Item 47. Rule 4.05.6(11)(1). The Division must find information required by Rule 4.05.6(11)(1) <br />for Permit renewal. In this regazd, please provide, in revised documentation as may be <br />appropriate, the water surface azea at high waterline (crest of the emergency spillway) for Pond <br />5-Pl. <br />Item 48. Rule 4.05.8(3). The Division has not found a determination in the Permit that mine <br />development waste (and in this case coal processing waste combined in the waste fills) is non- <br />acidforming and non-toxic. This rule applies to underground development waste as well as <br />spoil. Only spoil is addressed under pazagraph 4.05.8 on page 4,01-11 o1.'the Permit. Please <br />revise this pazagraph to discuss whether the underground development waste and wastes from the <br />coal processing (sepazation) station aze non-acid and non-toxic forming, and cross-reference <br />portions of the Permit (such as section 4.09 on page 4.01-20, Exhibit 21, the No. 9 portal azea, <br />etc.). <br />Item 49. Rule 4.05.14. Please provide copies of the approval of the permit applications to use <br />ground water for the Wise Hill No. 4 Mine and the No. 5 Mine Dischazge (Exhibit 2 of the <br />Permit). <br />Item 50. Rules 4.05.13(2)(a) & 2.05.6(3). What is the frequency for the: A series of pazameters <br />in Table 3A, page Ex.29-8a? Please revise this page as appropriate. <br />Item 51 Rules 4.05.13(2)(a) & 2.05.6(3)(iv). Note 1 of Table 2, Exhibit 29, refers to Table 5 and <br />9. Should this read Table 4 and 9? Please revise this page 7. <br />Item 52. Rule 4.07.2. The Division must approve the protection of the temporary sealing of the <br />temporarily inactive No. 5 Mine portals.
