~ , <br /> <br />Further, I respectfully petition this division to consider that Applicant has stated that he will not <br />be reclaiming the bench cut blasting azea on the mountain side. Yet in his Application for <br />Conditional Use Permit submitted to Fremont County for approval he cleazly stated that <br />"Minerals and Geology will assure that the property will be properly reclaimed." (Pazagraph 24). <br />Applicant further states in this application that Minerals and Geology Permits will "further reduce <br />impacts of the project"(Paragraph 29) as it relates to the general health, safety and welfaze of the <br />inhabitants of the county. I respectfully request that the Division of Minerals and Geology require <br />Applicant to submit a reclamation plan that addresses the bench cut mining area of their project. <br />At the least they can propose a revegetation of the azea as is addressed in your Construction <br />Materials Manual Rule 6.4.5 "Reclamation Plan". Specifically Rule 6.4.5 (2) (a) applies to this <br />situation. <br />Finally, I also petition this Board that the permitting process take into account the standards set <br />for the in Construction Materials Manual, Rule 3.1.8 (1), wherein Applicant is required to give <br />"special attention ... to critical periods in the life cycle of those species which require special <br />consideration". Such considerations should include the lambing and rutting seasons for Big Horn <br />Sheep and the spawning season for the Brown Trout in Tallahassee Creek. Since this area is also <br />inhabited by an active wild honeybee population which has grown scazce in the State of Colorado <br />I requrest that a special study be done to investigate how the added particulate level of pollution <br />from dust will affect this unique population and how Applicant proposes to mitigate these areas. <br />Thank you for considering my objections and requests regazding this Application. <br />Sincerely, <br />~~~ <br />Robert T.
