Effluent Limitations (continued) <br />e) Annual Revort: The permittee will be required to submit an annual <br />report, covering October 1 through September 30, on the overall <br />compliance with the SWMP. <br />7. Economic Reasonableness Evaluation: Section 25-8-503(8) of the revised <br />(June 1985) Colorado Water Quality Control Act required the Division to <br />"determine whether or not any or all of the water quality standard based <br />effluent limitations are reasonably related to the economic, <br />environmental, public health and energy impacts to the public and affected <br />persons, and are in furtherance of the policies set forth in sections <br />25-8-192 and 25-8-104." <br />The Regulations for the State Discharge Permit System, 6.1.0, further <br />define this requirement under 6.12.0 and state: "Where economic, <br />environmental, public health and energy impacts to the public and affected <br />persons have bean considered in the classifications and standards setting <br />process, permits written to meet the standards may be presumed to have <br />taken into consideration economic factors unless: <br />a) A new permit is issued where the discharge was not in existence at <br />the time of the classification and standards rulemaking, or <br />b) In the case of a continuing discharge, additional information or <br />factors have emerged that were not anticipated or considered at the <br />time of the classification and standards rulemaking." <br />The evaluation for this permit shows that the Water Quality Control <br />Commission, during their proceedings to adopt the Classification and <br />Numeric Standards for the Lower Colorado River Basin, considered economic <br />reasonableness. <br />Furthermore, this is not a new discharger and no new information has been <br />presented regarding the classifications and standards. Therefore, the <br />water quality standard-based effluent limitations of this permit are <br />determined to be reasonably related to the economic, environmental, public <br />health and energy impacts to the public and affected persons and are in <br />furtherance of the policies set forth in Sections 15-8-102 and 104. If <br />the permittee disagrees with this finding, pursuant to 6.12.0(2)(b) the <br />permittee should submit all pertinent information to the Division during <br />the public notice period. <br />8. Antidegradation: These are not reviewable waters pursuant to Section <br />3.1.8(3)(a) of the Basic Standards and Methodologies for Surface Water <br />(SCGR 1002-2), based on a finding of no increased water quality impact. <br />B. Monitoring and Reporting <br />1. Monitoring: Tables VI-9, VI-10, VI-11 and VI-12 list the monitoring <br />requirements for all authorized outfalls (outfalls 001 - 010, 016 - 017 <br />and 019), including sample type and frequency. <br />
