Effluent Limitations (continued) <br />Chronic Biomonitorine (continued): Discharges from outfalls 001, 005 and <br />007 go to Foidel Creek, which is classified aquatic life 1 (cold). On <br />this basis, chronic WET testing Ss required for these outfalls regardless <br />of the dilution ratio. Such testing shall be semi-annually, with two <br />species for the first year, and with only the most sensitive species <br />during years two and three. After the third year of monitoring, the <br />chronic testing requirement ends unless applicable regulations are <br />adopted. <br />General Information: The permittee should read the WET testing sections of <br />Part I.A. and I.B. of the permit carefully, and should note that the test <br />methods for the toxicity tests are described in detail in the Division <br />guidance document, Guidelines for Conducting Whole Effluent Toxicity <br />Tests. This document should be read thoroughly prior to commencing the <br />required WET testing, to ensure that the permittee is aware of the various <br />test conditions that could affect the test results (e.g., sample holding <br />time). <br />The permittee should be aware that some of the conditions outlined above <br />may be subject to change if the facility experiences a change in <br />discharge, as outlined in Part II.A.1 of the permit. Such changes shall <br />be reported to the Division immediately. <br />WET Testing Waiver For Outfalls 002 - 004. 006. 008 - 010. 016 and 017: <br />Based upon the exemption for coal mining surface runoff, as allowed in the <br />Regulations for the State Discharge Permit System (6.1.0), WET testing is <br />not a requirement for these outfalls. However, the Division reserves the <br />right to reopen the permit to include WET testing, should facility <br />conditions change or if new information becomes available. <br />6. Stormwater: Active and inactive coal mining operations where stormwater <br />comes into contact with overburden, raw material, intermediate products, <br />byproducts, finished products or waste products located at the mining site <br />are included in category (iii) of the federal stormwater regulations. <br />Such facilities are required to have applied for a permit to discharge <br />stormwater associated with mining activity on or before October 1, 1992. <br />Cyprus Yampa Valley Coal Corporation submitted an application for a <br />general permit for stormwater discharges for the Eckman Park and Mines 1, <br />2 and 3 South site on October 1, 1992. This facility's certification <br />under the general permit became effective on November 1, 1992. The Eckman <br />Park and Mines 1, 2 and 3 South certification number is COR-040076. <br />Much of the stormwater from Eckman Park and Mines 1, 2 and 3 South is <br />already controlled by effluent limitation guidelines. The new stormwater <br />requirements apply to areas that were not previously regulated, such as <br />small area exemptions. <br />Since the requirements for stormwater permits have just recently become <br />effective, the Division's policy is to cover as many facilities as <br />possible that are included in the regulations, with general permits. <br />
