PART II <br />Page No. 25 <br />Permit No. CO-0045161 <br />B. RESPONSIBILITIES <br />5. Modification Susuension. Revocation. or Termination of Permits By the Division (continued) <br />d. Perini[ modification (except for minor modifications), termination or revocation and reissuance actions shall be subjec[ <br />to the requirements of Sec[iotu 61.5 (2), 61.5 (3), 61.6, 61.7 and 61.15 of the Colorado Dischazge Permit System <br />Regulations. The Division shall act on a permi[ modification reques[, other than minor modifications requests, within <br />180 days of receipt thereof. Except for minor modifications, the terms of the existing permi[ govern and aze <br />enforceable until the newly issued permit is formally modified or revoked and reissued following public notice. <br />e. Upon consent by the permittee, the Division may make minor permi[ modifications without following the requirements <br />of Sections 61.5 (2), 61.5 (3), 61.7, and 61.15 of the Colorado Dischazge Permit System Regulations. Minor <br />modifications to permia aze limited [o: <br />i. Correcting typographical errors; or <br />ii. Increasing the frequency of monitoring or reporting by the permittee; or <br />iii. Changing an interim date in a schedule of compliance, provided the new date of compliance is not more than 120 <br />days after the date specific in the existing permit and does no[ inrerfere with attainment of the final compliance <br />date requirement; or <br />iv. Allowing for a transfer in ownership or operational control of a facility where the Division determines that no <br />other change in the permit is necessary, provided that a written agreemen[ containing a specific date for transfer <br />of permit responsibility, coverage and liability between the current and new permittees has been submitted to the <br />Division; or <br />v. Changing the construction schedule for a dischazger which is a new source, bu[ no such change shall affect a <br />dischazger's obligation to have all pollution control equipment installed and in operation prior to dischazge; or <br />vi. Deleting a point source outfall when the discharge from that outfall is [ertninated and does not result in dischazge <br />of pollutants from other outfalls except in accordance with permit limits. <br />f. When a permit is modified, only [he condi[ions subject to modification aze reopened. If a permit is revoked and <br />reissued, the entire permit is reopened and subject to revision and the permi[ is reissued for a new term. <br />g. The filing of a request by the permittee for a permit modification, revocation and reissuance or termination does not <br />stay any perrni[ condition. <br />h. All permit modifications and reissuances aze subject to antibacksliding provisions set forth in 61.10 (e) through (g). <br />6. 9il and Hazardous Substance Liability <br />Nothing in this permit shall be construed [o preclude the institution of any legal action or relieve the permittee from any <br />responsibilities, liabilities, or penalties ro which the pertnittee is or may be subject to under Section 311 (Oil and <br />Hazazdous Substance Liability) of the Clean Water Act. <br />7. State Laws <br />Nothing in this pertni[ shall be construed ro preclude the instim[ion of any legal action or relieve the permittee from any <br />responsibilities, liabilities, or penalties established pursuant [o any applicable Slate law or regulation under authority <br />granted by Section 510 of dte Clean Water Act. <br />8. Permit Violations <br />Failure to comply with any terms and/or condi[ions of this permi[ shall be a violation of this permit. The discharge of any <br />pollu[an[ iden[ified in this permit more frequently than or at a level in excess of tha[ authorized shall constim[e a violation <br />of the permit. <br />
