If the facility is capable of handling spills in-hosts[:, [his shall be documen[ed in the plan; <br />g. Provision for yearly review and updating of the con[ingency plan, plus resubttti.;sion of the plan [o the Division if <br />conditions and/or procedures at the facility change the original plan. <br />The foregoing provisions shall in no way render inapplicable those requirements imposed by the Federal Water Pollution <br />Control Ac[, 33 U.S.C. § 1321, regulations promulgated thereunder, the Colorad[> Water Quality Control Ac[, and <br />re~ltlarions promulgated thereunder. It is recommended that this plan be prepared by a professional engineer regis[ered in <br />the State of Colorado. <br />Nothing herein contained shall be coas[rued as allowing any discharge to wa[ers of the Stale other than through the <br />discharge points specifically authorized in this permit. Nothing herein contained shall be construed as excusing any <br />liability the permittee might have, civil or criminal, for any spill. <br />The submittal of a Spill Preven[ion Control and Countermeasure Plan (SPCC Plazl) as required by 40 CFR Part 112 may <br />satisfy all or part of [his requirement. GENE:R_AI, MONITORING, SAMPLING AND REPORTING REQUIItEMENTS <br />1. Routine Reportine of Data <br />Reporting of the data gathered in compliance with Pan I.B.1 shall be on a ua arterly basis. Reporting of all data gathered <br />shtdl comply with the requirements of Part I.E. (General Requiremen[s). Monitoring results shall be summarized for each <br />calendar quarter and repotted on Division approved discharge monitoring repott (DMR) forms (EPA form 3320-1). The <br />forms shall be mailed to the agencies listed below so they are received no Inlet than the 28th day of the month following <br />[he: end of the quaver (for example, [he DMR for [he first calEndaz quarter mus[ be received by the Division by April <br />28th). If no discharge occurs during the reporting period, "No Discharge" shall be reported. <br />The DMR forms cotlsist of four pages -the top "original" copy, and three attached no~azbon-required copies. Af[er the <br />DPdR form has been filled out and signed, the four copies must be separated and distributed as follows: <br />The first ri 'nal signed copy of each discharge monitoring report (DMR) shall be submitted [o the Division at the <br />following address: <br />Colorado Department of Public Health and Environment <br />WQCD-Permits-B2 <br />4300 Cherry Creek Drive South <br />Denver. CO 80222-1530 <br />Acidi[ional copies are for the permittee records. The Dischazge Monitoring Report forms shall be fdled ou[ accurately and <br />comple[ely in accordance with requirements of this permit and the ins ructions on the forms. They shall be signed by an <br />authorized person as identified in Part I.E.6. <br />C~dcula[ions for all limitations which require [he averaging of measurements shall u[ilize an arithmetic mean unless <br />odterwise specified by the Division in the permi[. <br />
