` : ~ :. <br />601488 <br />This project will be reviewed annually for <br />compliance with the conditions of this <br />approval. This land use approval is expreasl'y <br />contingent upon and subject to the applicant's <br />receipt of all State and local permit <br />approvals. Should any State or local agency, <br />whose approval is required for this operation, <br />suspend or revoke such approval for the <br />operation, the County's land use approval shall <br />be deemed suspended or revoked as appropriate. <br />Any written allegations that the High Flume <br />Gravel Pit, Project No. 90-40 is operating in <br />violation of the terms and conditions of this <br />approval shall be referred to the County <br />Planning Staff for investigation. The County <br />Staff shall promptly investigate any ouch <br />written allegation concerning.violationa and <br />report their findings to the Board of County <br />Commissioners <br />Should the County Staff find that there is <br />substantial cause to believe .that the operation <br />is in violation of the terms and conditions of <br />this approval, they shall provide the Board of <br />County Commissioners, the Agent and the Owner <br />of the property with a written notice <br />specifying the basis for the violation. The <br />Agent/Owner shall have a period of not to <br />exceed (10) ten days from the receipt of the <br />notice to remedy the violation. Should the <br />Agent /Owner fail or refuse to remedy the <br />violation within the (10) ten day period <br />specified, the Board of County Commissioners <br />shall conduct a noticed public meeting on said <br />violation, at which time the Agent/Owner and <br />members of the public may be present. The <br />Agent/Owner will be given at least (10) ten <br />days notice of the public meeting and of the <br />alleged violation. Reasonable prior notice of <br />such public meeting shall also be given to <br />members of the public as well as being <br />published in the official county Newspaper. The <br />Agent/Owner and members of the public shall be <br />given an opportunity to be heard on the alleged <br />violation at such public meeting. The burden <br />shall be on the County staff to present <br />substantial competent evidence in support of <br />the continuing violation.
