Revised control measures shall be implemented a timely manner, but in <br />no case more than 90 calendar days after the itupection, unless otherwise provided by the Division. <br />3) The operator shall keep a record of inspections, including the dale of dre inspection, major observations <br />relating to the implementation of tht SWMP, and actions taken in accordance with paragraph 2), above. <br />This record shall be made available to the Division upon request and ~ m the Annual or <br />Compliance Report. set <br />6. Monitorine <br />Sampling and testing of stormwater for specific parameters is not required on a routine bazis under this permit. The <br />Division reserves the right ro require sampling and testing, on a case-by~ase basis, in the event that there is reason <br />[o suspect that compliance with the SWMP is a problem, or to measure the effectiirness of the BMPs in removing <br />pollutants from the dischazge. <br />SWMP Availability <br />Upon reques[, the perntittee shall submit a copy of the SWMP to the Division, the Colorado Division of Minerals <br />and Geology and EPA, and any local agency approving sediment and erosion plans or stormwater management <br />plans, within the time frames specified in the reques[. <br />All SWMPs required under this permit are considered reports that shall be available to the public under Section <br />308(b) of the CWA. The owner or operator of a facility with stormwater discharge covered by this permit shall <br />make plans available to members of the public upon request, unless the SWMP has been submitted to the Division. <br />However, the permittee may claim any portion of a SWMP as confiden[ial in accordance with 40 CFR part 2. <br />E. REPORTING REQUIREMENTS <br />1. Reportine <br />ti. <br />a. Annual Report for Active Mining Operatioas. The permittce will be required to submit an Annual Report, <br />covering January 1 through December 31 of each yeaz, on the compliance with.the SWMP. The Annual Repon <br />will contain, at a minimum: <br />1) Name of permittce, address, phone number, and permit certification number. <br />2) A report on the facility's overall compliance with the SWMP. ~ ' <br />3) A summary of each comprehensive stormwater facility inspection made, ' eluding date, fmdings, and <br />ac[ion taken. <br />4) Results and interpretation of any stormwater monitoring performed. <br />5) Certification language and signature by the pertttittee. (See Part I.E.2 of the permit.) <br />The Annual Report will be due to the Division on or before February 15 of each yeaz. The exact due date for <br />the permit[ee's fits[ Annual Report will be listed in their gettnit certification. I e Division reserves the right to <br />require addi[ional information in the report, on a case-by-case basis, as needed. <br />b. Compliance Report For Inactive Mining Operations: The permit[ee will be required to submit a report on the <br />compliance with the SWMP.
