BASIC TERMS AND CONDITION -ALL FACILITIES (con[.) <br />otherwise provided by the Division, the permittee shall have 30 days after such notifica[ion to both make the <br />necessary changes to the plan and to implement them. <br />The permittee shall amrnd the plan whenever there is a change in design, constmction, operation, or <br />maintenance which has a significant effect oa the potential for the dischazge of pollutanu to the waters of the <br />State, or if the SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in <br />stormwater discharges associated with mining activity. Amendments to the plan shall be summarized in the <br />Annual or Compliance Report. <br />Prohibition of Non-stormwater Discharees <br />a. Except as provided in paragraph b, below, all discharges authorized by this permit shall be composed <br />entirely of stormwater. Dischazges of wa[er other than stormwater must be addressed in a sepazate CDPS <br />permit issued for that dischazge. <br />b. Discharges from the following sources that aze combined with stormwater dischazges associated with mining <br />activity may be authorized by this permit, provided that the non-stormwater component of the dischazge is <br />identified in the SWMP (see Part I.B.4.g of the permit): fire fighting activities, uncontaminated compressor <br />condensate, irrigation drainage, lawn watering, air conditioner condensate, uncontaminated seeps and springs, <br />and foundation or footing drains where flows are not contaminated. <br />Releases in Excess of Reportable Quantities <br />t <br />This permit does not relieve the permittee of the reporting requirements of 40 CFR I10, 40 CFR 117 or 40 CFR <br />302. Any discharge of hazardous material mus[ be handled in accordance with the Division's Notification <br />Requirements (see Part II.A.3 of the pentrit). <br />5. Facility Inspections <br />a. Active Mining Operations. Qualified persomel identified by the operator shall make a thorough inspection of <br />their stonnwater management rystem, at least twice per yeaz (in the spring and fall). Where semi-annual site <br />inspections aze shown in the plan [o be impracticable because an employee is not stationed or does not routinely <br />visit the site, inspections as required in this part shall be conducted at appropriate intervals specified in the plan, <br />but never less than once in two years. Thesc inspections must be documented and summarized in the Annual <br />Report (see Part I.E.1 of the permit). , <br />b. Inactive Mining Operations. Qualified personnel identified by the operator shall make a thorough inspection <br />of their stormwater managemrnt system, at least once per yeaz. Where amual inspections aze shown in the <br />plan to be impracticable, because an employee is not stationed at or does not routinely visit the site, an <br />inspection and certification is required once every three years by a Registered Professional Engineer that the site <br />is in compliance with the plan. These inspections must be documented and su*++R+a*+~ed in the Compliance <br />Report (see Part I.E.1 of the permit). <br />c. Remediatioa Operations. Qualified personnel identified by the operator shall make a thorough inspection of <br />their stonnwater management system, at least once per yeaz (in the field season). Where annual site inspections <br />are shown in the plan to be impracticable, because an employee is not stationed at or does not routinely visi[ the <br />site, inspections as requited in this part shall be conducted az appropriate intervals specified in the plan, bu[ <br />never less than once in two years. These inspections must be documented and summam~~t in the Annual <br />Report (see Pan 1.E.1 of the permit). <br />d. InspeMion Requirements -ALL Operatiot. The inspections as required above must include the following: <br />1) Disturbed azeas and areas used for material s[orage that are exposed to precipitation shall be inspected for <br />evidence of, or the potential for, pollutants en[ering the drainage system.
