<br /> <br />sl. In Exhibit C, the applicant states that 3,000 cubic yards of topsoil will be stockpiled and <br />replaced to a depth of S' during reclamation. The Division estimates that 3,000 cubic yards <br />of topsoil replaced over 9.9 acres will average 2.25' in depth. Please commit to salvaging <br />enough topsoil to cover the site with at least 6" of topsoil prior to revegetation efforts. <br />Rule 1.1(48) defines "Structure, Sienificant, Valuable and oermanent Ivlan-made" as a non- <br />portable improvement to real property which has defined, current and recognizable value of <br />an economic nature; generally including but not limiting to: buildings, houses, barns, fences, <br />above or below ground utilities, irrigation ditches, maintained or public roads, bridges, <br />railroad tracks, etc. The reclamation plan map notes two permanent man-made features <br />within 200 feet of the affected azea, a fence around the Phase One Block and State Highway <br />61 located southwest of the site. <br />Where the mining operation will adversely affect the stability of any significant, valuable or <br />permanent man-made structure located within 200 feet of the affected land, the applicant may <br />either: <br />• Provide a notarized agreement between the Applicant and the Person(s) having an interest <br />in the structure ,that the Applicant is to provide compensation for any damage to the <br />structure; or <br />• Where such an agreement can not be reached, the Applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by <br />activities occurring at the mining operation. <br />The applicant will need to submit the notazized agreement or engineering evaluation for the <br />fence surrounding the phase one area and State Highway 61. <br />The Division received comments from the Army Corps of Engineers and the Division of <br />Wildlife. Where applicable, the comments/suggestions should be incorporated in the permit <br />application. <br />Please be advised that the Bob Terrill Clay Pit New Application may be deemed inadequate and <br />the application may be denied on May 20, 1999 unless the above mentioned adequacy review <br />items aze addressed to the satisfaction of the Division.
