Request for Termination <br />When a si[e has been reclaimed in accordance with [he CDMG requirements and the site has been released from <br />State reclamation requirements, or the above Termination Criteria have been met, the permittee may request <br />certification termination. The Division will consider termination of permit coverage when: <br />a. the permittee bas submitted a completed Inactiva[ion Form as provided by [he Division which summarizes the <br />work accomplished; <br />b. In the case of mine-waste remediation projects, the permittee has submitted photographic documen[ation of the <br />post remediation conditions at the mine site; <br />c. All stotmwater dischazges to stale waters associated with mining activities have ceased and [he permit[ce has <br />demonstrated to the Division the termination criteria have bcen met or the CDMG performance bond has been <br />released; <br />d. The Division fords that the permittce has shown reasonable grounds consistent with the Federal and State <br />statutes and regulations for such termination; and <br />e. Fce requirements of Section 6.16.0 of State Discharge Permit System Regulations have bcen met. <br />Continued coverage may be required aher reclamation or remediation has been completed if [he Division has shown or <br />has reason to suspect that the stormwater discharge may contribute [o a violation of a water quality standazd. <br />G. ADDITIONAL DEFINI'T'IONS <br />• 1. Best management practices (BMPs): schedules of activities, prohibitions of practices, maintenance procedures, <br />and other management practices to prevent or reduce the pollution of waters of the.State. BMPs also include <br />[reatment, operating procedures, and practices to conuol site runoff, spillage or leaks, waste disposal, or drainage <br />from material storage. BMPs include structural and nonstmctural controls. <br />2. Operator: the individual who has day-today supervision and conuol of activities occurring at the mine site. <br />3. Remediation, as used in this permit, means actions taken ro reduce or eliminate the overall adverse environmental <br />impact associated with a pollutam source. The term includes actions such as re-routing of surface flows, re-location <br />or a pollutant source, the addition of pollutant neutralizing or immobilizing substances, capping and re-vegetation. <br />4. Significant Materials include but are not limited to: raw materials; fuels; materials such as metallic products; <br />hazardous substances designated under section 101(14) of CERCI.A; fertilizers; pesticides; and waste products such <br />as ashes, slag and sludge that have the potential to be released with stormwa[er dischazge. <br />5. Vegetative Cover is the aerial projection of all grasses, fortis, mosses (living or dead) onto the ground. <br />PART II <br />A. MANAGEMENT REQUIItEMENTS <br />1. Chanee in Discharee <br />The permittee shall inform the Division (Permits and Enforcement Section) in writing of any intent to construct, <br />• ins[all, or alter any process, facility, or ac[iviry that is likely to result in a new or al[ered discharge, and shall <br />famish the Division such plans and specifications which the Division deems reasonably necessary to evaluate the <br />effect on the dischazge and receiving stream. The SWMP shall be updated within 60 days of the changes. The <br />
