Whole Effluent Toxicity-Chronic Lethality Limitation -Outfalls 003, 022 and 024 <br />Beginning April I. 1997, and lasting through March 31, 1999, there shall be no statistically significant difference in lethality <br />(at the 95% confidence level) between the control and any effluent concentration less than or equal to I I.5% efFluent. Such <br />limitation shall apply as a daily maximum. <br />3. Burden of Proof Requirements <br />The pertnittee has the burden of proof when seeking relief from settleable solids (SS) limitations. Discharges from outfalls <br />004, 007, 009, OI I - 021 are eligible for this exemption. <br />Relief may be granted for each discharge occurrence only when necessary and shall not be granted when the permittee has <br />control over the discharge. The permittee should endeavor to meet the primary limitations whenever possible. <br />a) For rainfall, to waive settleable solids limitations, it is necessary to prove that dischan;e occurred within 48 hours after <br />precipitation greater than the 10-year, 24-hour event has stopped. <br />b) For snowmelt, to waive settleable solids limitations, it is necessary to prove that discharge occurted within 48 hours after <br />pond inflow volume greater than the 10-year, 24-hour event has stopped. <br />Should a precipitation event or snowntelt occur, the petmittee shall submit adequate proof in order for an exemption to be <br />claimed. Weather station data may be appropriate in making this demonstration. Said proof shall be submitted as an <br />attachment to the Discharge Monitoring Report (DMR) for the appropriate period. The Division shall determine the <br />adequacy of proof. As part of this deterntination, the Division shall evaluate whether the permittee could have conttolled the <br />discharge in such a manner that primary limitations could have been met. All manual dew:uering of the ponds shall meet <br />settleable solids limitations. <br />4. Salinity Parameters <br />In order to obtain an indication of the quantity of Salinity being discharged from the site, the permittee shall monitor the <br />wastewater efFluenl for total dissolved solids at the following frequencies: <br />Outfall Frequency Sample Tvae <br />003,004,007,009,011,012,013,014,015, Quarterly Grab <br />016, 017,OIR,019,02Q 021,022,023 and 024. <br />Self-monitoring samples taken in compliance with the monitoring requires specified above shall be taken a[ those locations <br />listed in Part I.B.I. <br />See Part I.C. for Definitions. <br /> <br />
