<br />Permit No.: CO-0034142 <br />County: Mo1Tat <br />AUTHORIZATION TO DISCHARGE UNDER THE <br />COLORADO DISCHARGE PERMIT SYSTEM <br />Incompliance with the provisions of the Colorado Water Quality Control Act, (25-8-I OI e[ seq., CItS, 1973 as amended) and the <br />Federal Water Pollution Conirol Act, as amended (33 U.S.C. 1251 et seq.; the "Act") the <br />CYPRUS EMPIRE CORPORATION <br />is authorized to discharge from the Eagle Mine Complex located in Sec 6., TSN, R91 W, and Sections 30, 31, 32 T6N, R91 W to the <br />Williams Fork River and Yampa River in accordance with effluent limitations, monitoring requirements and other conditions set forth <br />in Part I and II hereof. All discharges authorized herein shall be consistent with the terms and conditions of this permit. <br />The applicant may demand an adjudicatory hearing within thirty (30) days of the issuance of the fin;tl permit determination, per the <br />Regulations for the State Discharge Permit System, 6.R.0 (1). Should the applicant choose to contest any of the etTluenl limitations, <br />monitoring requirements or other conditions contained herein, the applicant rnusl comply with Section 24-4-104 CRS 1973 and the <br />Regulations for [he State Discharge Permit System. Failure to contest any such efFluent limitation, ronitoring requirement, or other <br />condition, constitutes consent to the condition by the Applicant. <br />This permit and the authorization to discharge shall expire at midnight, March 31, 1999. <br />Issued and Signed this day of <br />COLORADO DEPARTMENT OF HEALTH <br />1.
