Whole EfBuent Toxici[y-Chronic Lethality Limitation -Outfalls 003, 022 and 024 <br />Beginning April I, 1907, and lasting through March 31. 1999, there shall be no statisticalbr significant dif7erence in lethality <br />(at the 95% confidence level) between the control and any effluent concentration less than or equal to I I.5% effluent. Such <br />limitation shall apply as a daily maximum. <br />3. Burden of Proof Requirements <br />The pertnittee has the burden ofproof when seeking relief from settleable solids (SS) limiuttions. Discharges from outfalls <br />004, 007, 009, 011 - 021 are eligible for this exemption. <br />Relief maybe granted for each discharge occurrence only when necessary and shall no[ be granted when the permittee has <br />control over the discharge. The permittee should endeavor [o meet the primary limitations whenever possible. <br />a) For rainfall [o waive settleable solids limitations, it is necessary to prove that discharge occurred within 4R hours after <br />precipitation greater than the 10-year, 24-hour event has slopped. <br />b) For snovnnelt, to waive settleable solids limitations, it is necessary to prove that discharge occurred within 48 hours after <br />pond inflow volume greater than the 10-year, 24-hour event has stopped. <br />Should a precipitation event or snowmelt occur, the permittee shall submit adequate proof in order for an exemption to be <br />claimed. Weather station data ntay he appropriate in making this demonstration. Said proof shall be submitted as an <br />attachment to the Discharge Monitoring Report (DMR) for the appropriate period. The Division shall determine the <br />adequacy ofproof. As part of this determination, the Division shall evaluate whether the p°rmittee could have controlled the <br />discharge in such a manner that primary limitations could have been met. All manual dewatering of the ponds shall meet <br />settleable solids limitations. <br />4. Salinity Parameters <br />In order to obtain an indication of the quantity of Salinity being discharged front the site, the pemtittee shall monitor the <br />wastewater effluent for total dissolved solids at the following frequencies: <br />Outfall Frequency Sample Tvae <br />003, 004, 007, 009, OI 1, 012, 013, 014, 015, Quarterly Grab <br />016, 017, OIR, 019, 020, 021, 022, 023 and 024. <br />Self-monitoring samples taken incompliance with the monitoring requires specified above shall be taken a[ those locations <br />listed in Pan l.B.l. <br />Amendment No. I Issued Effective <br />See Part I.C. for Definitions. <br />
