Employee Education -The SW MP shall include an employee education prcgram to inform personnel at all <br />levels of responsibility of the components and goals of the SWMP. Education should address topics such as <br />spill response, good housekeeping and material management practices. The :iWMP shall identify periodic dates <br />for such instruction. <br />h. Testing for Non-Stormwater -The SWMP shall include certification that ttie discharges have been tested or <br />evaluated for the presence ofnon-Stormwater discharges such as mine drainage, contaminated springs, sanitary <br />waste. or process water of any kind. The certification shall include a description of the results of any test for the <br />presence of non-Stormwater discharges, the method(s) used, the date of any testing, and the on-site drainage <br />points that were directly observed during the test. If the certification is based. solely on interpretation of the <br />regulations, a justification of this interpretation must be included. <br />vi) Comprehensive Inspection. The SW MP shall identify qualified personnel who shall inspect designated equipment <br />and mine areas at appropriate intervals specified in the plan (at least twice a year, in the spring and fall). <br />vii) Recordkeemine and Internal Reoortine Procedures. The SWMP shall identify procedures for recordkeeping and <br />internal reporting. <br />viii)Consistencvwtth Other Plans and Availabililv. The SW MP may reflect requirements for Spill <br />Prevention Control and Countermeasure (SPCC) plans under section 31 I of the CWA, or Best Management <br />Practices (BMPs) Programs otherwise required by a CDPS permit, and may incorporate any part of such plans into <br />the SWMP by reference. The SWMP may rely upon information developed for other similar pollution control <br />programs, including the Mined Land Reclamation Plan. Appropriate portions of these other plans may be <br />incorporated in the SW MP by reference, as long as a complete S W MP can be reproduced and submitted to the <br />requesting agency within the time frame specified in the request. Those portions of the referenced documents must <br />be included in the submittal. The complete SWMP must also be readily available to an on-site inspector. <br />ix) Allowable Non-Stormwater Discharees. The plan shall identify all sources of irrigation return flow and natural <br />uncontaminated spring water that are combined with Stormwater discharges associated with industrial activity. The <br />plan shall identify and ensure the implementation of appropriate measures to prevent pollution of the non-stomtwater <br />component(s) of the discharge. <br />Iriga[ion return Flow and natural spring water which mix with mine drainage or process water become mine drainage <br />or process water. <br />d) Stormwater Management Plan Review, Implementation, and Compliance <br />i) SWMP Review/Chanecs: Upon review of the SWMP, the Division may notify the permittee at any time that the plan <br />does not meet one or more of the minimum requirements of this permit. After such notification, the pernittee shall <br />make changes to the plan and shall submit to the Division an update to the plan including the requested changes. <br />Unless otherwise provided by the Division, the permittee sh;tll have 30 days after :such notification to both make the <br />necessary changes to the plan, to implement them, and to submit the changes to the Division. <br />The permittee shall amend the plan whenever there is a change in design, construction, operation, or maintenance <br />which has a significant effect on the potential for the discharge of pollutants to the waters of the State, or if the <br />SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in Stormwater discharges <br />associated with industrial activity. <br />vfls67-.z,., <br />
