Materials Containment Plan (continued) <br />Nothing herein contained shall be constmed as allowing any discharge to waters of the State other than through the discharge <br />points specifically authorized in this permit. Nothing herein contained shall be construed us excusing any liability the <br />pentti[tee might have, civil or criminal, (or any spill. <br />The submittal of a Spill Prevention Control and Countermeasure Plan (SPCC Plan) as required by 40 CFR Part 112 may <br />satisfy all or part of this requirement. Should additional materials exist on site which are not addressed in the SPCC Plan, <br />addressing those materials as per the above is required. <br />I/ if there is no such material present at the site, this shall be indicated in writing and submitted to the Division for review. <br />?/ If there is material present but the perntittee feels [here is not a reasonable probability of a spill impacting waters of the State, this <br />shall be documented in writing and submited to the Division for review. This documentation shall include; I) distance to nearest <br />surface waters, and; 2) a detailed description of any structure which prohibits the release of material onto the ground or into a <br />conveyance system. <br />2. Stormwater Requirements <br />a) General Limitations <br />i) Stormwater which mixes with process water or mine drainage is subject to effluent limitation guidelines. <br />ii) Stormwater discharges from active or inactive mining operations activities shall not cause or threaten to cause <br />pollution, contamination or degradation of State waters. <br />iii) Bulk storage structures for petroleum products and other chemicals shall have adequate protection so as to contain <br />all spills and prevent any spilled material From entering State waters. <br />b) Stormwater Manag_emen[ Plan -Contents and Requirements <br />A Stormwater Management Plan (SWMP) shall be developed for the portions of the Eagle Mine Complex that are <br />coveted by this section of the permit. The SW MP shall be submitted to the Division. 'ihe SW MP shall include the <br />following items, at a minimum: <br />i) Description of Mining Activities. The plan shall provide a narrative description of the mining and associated <br />activities taking place at the Eagle Mine Complex, or having taken place in the past, which affect or may affect <br />Stormwater mnoff intended to be covered by this permit. The narrative description shall report the total acreage <br />within the mine site and an estimate of the number of acres of disturbed area. <br />ii) Area Subject to Effluent Limitations Guidelines. The SWMP shall describe the portions of the site which contribute <br />runoff to areas subject to efFluen[ limitations guidelines contained in 40 CFR subchapter N. <br />curia',:.<• <br />
