RE: CERTIFICATION OF FRESH WATER IMPOUNDMENT POND NO. 3,
SOUTHFIELD MINE, FLORENCE, COLORADO (Ist Quarter, 1999)
Dear Al;
On Mazch 17, 1999, an inspection was conducted on the Fresh Water
Impoundment Pond No. 3 currently in place at your Southfield mine. The inspection was
performed by myself, John Effinger IQ, a registered professional engineer in the State of
Colorado since December, 1975. I have experience and knowledge in the design and
construction of dams, drainage control, hydrology and structures; including experience in
portions of the permitting process of coal mine facilities and permit compliance.
The purpose of this inspection and certification was to check for structural
weakness, erosion, other hazardous conditions and identify requ'ved maintenance and to
satisfy the requirements of Rule 4.05.9 (13) of the Colorado Mined Land Reclamation
Board for Coal Mining. In addition to [he on site inspection referenced above, actions
taken in preparing this certification included review and discussion of applicable mine
maps and state regulations with yourself.
Said inspection was performed on a mild (45°), mostly stmny Wednesday morning
by myself. Most of the site was traversed with a four wheel drive vehicle with frequent
stops and hiking trips azound the pond. The following is a statement of my professional
observations and conclusions from this inspection:
The entire impoundment was examined for structural weakness, erosion, tears to
hypalon lining and other hazardous conditions; none were found.
Existing water level was about 4% feet below maximum level line.
Hypalon lining in good condition. Several small tears in the hypalon lining were
observed along the north and west sides, well above high water level, and two new
tears along the south face.
