Eveti though this plan expires in October 1993, the anticipated depletiots to the <br />river in the pursuing year; will still be your responsibility to augment. The <br />yearly depletions, as calculated using the Glover technique, aze anticipated to ~ <br />be 13.87, 14.52, 14.56 and 14.57 acre-feet for yeazs two, [hree, four and five, <br />respectively. Should the applicant seek to continue to operate this gravel pit <br />next year, previous years' depletions reaching the river must also be replaced. <br />4. There is a timing deficiency with this plan. The consumptive credits from the <br />Boyd and Freeman Ditch do not appear to provide replacement water when the <br />depletion actually occurs. Prior to renewal or approval of nest yeas plan, an <br />engineering report must be submitted showing that depletions at times of call <br />by senior water rights are replaced. <br />5. Prior to renewal or approval of next year's plan, the 14.1 shares of the Boyd and <br />Freeman Ditch attributable to this plan must be tied to both the land containing <br />the exposed ground water pond and to the successive users in order to cover <br />lake evaporation. This may be done by recording a document at the county <br />office setting the shares to the land. This document must remain in effect for <br />~' as long as the ground water pond exists. <br />6. A map and/or a legal description of the acres historically irrigated by Bestway <br />Paving's shares of the Boyd and Freeman Ditch and the dry-up of the proposed <br />10 acres must be submitted and verified by the Division Engineer prior to <br />approval and renewal of next year's plan. In addition, the amount of water that <br />will be bypassed for historic return flow obligations from the 14.1 shares must <br />be calculated and submitted to this office. This water may remain either in the <br />river or the ditch, but may not be used for any other purposes, so as not to <br />cause an expansion of use. <br />7. Approval of this plan is for the purpose as stated herein. Arty additional uses <br />for which the water may be used must first be approved by this office. <br />8. Adequate accounting of diversions and replacements must be provided to the <br />Division Engineer in Greeley and Water Commissioner (Keith Delventhal, 25461 <br />Weld County Road 50, Kersey, CO 80644, 284-6338) on a monthly basis or <br />other interval acceptable to both of them. The accounting form provided with <br />your application is subject to modification and approval by the Division <br />Engineer. All amounts shall be requested in acre-feet. <br />9. The name, addres,, and phone number of a contact person who will be <br />~.'. <br />responsible for the operation and accounting of this plan must be provided to <br />the Division Engineer and Water Commissioner. <br />
