Compliance with Terms and Conditions of Previous Permit <br />Inspections of the facility by Division representatives on June 12, <br />1989, September 12, 1990 and August 28, 1991 showed the following <br />minor compliance problems: <br />The permittee does not yet have a Class C operator. Their current <br />operator intends to pursue Class C Certification, but is now only <br />certified as a Class D operator. Problems with sediment buildup on <br />the Parshall Flume have been corrected as of the most recent <br />inspection. The inspection in 1990 raised the possibility that the <br />Roosevelt Tunnel may also have drainage that would require a discharge <br />permit. No discharge from the Roosevelt Tunnel was noted at the most <br />recent inspection and this permit requires the permittee to begin <br />visual inspections of the Roosevelt Tunnel in the event of new <br />underground activity in the Carlton Tunnel to assure that there is no <br />new or constant flow from the Roosevelt Tunnel as a result of resumed <br />mining activity. <br />
