Pitkin County states that the County has no information on the relationship between Avalanche <br />Creek Marble & Alabaster LLC and the entity noted by the County as the permittee. The Division <br />has no jurisdiction on the identity submitted to Pitkin County. Once the financial warranty is <br />received and approved by the Division. the permit will be issued to Avalanche Creek Marble & <br />Alabaster LLC. It is the operator's responsibility to ensure that the proper information is supplied to <br />local governments. <br />Please be aware that the Division approved the 110(2) application for the White Banks Ivtine on August <br />25, 1999. In accordance with Rule 1.4.7 of the Hard Rock/Ivtetal Ivtinin, Rules and Regulations, any <br />person aggrieved by the final action of the Division may file an appeal of such action before the Mined <br />Land Reclamation Board within sixty (60) days of the date of the Division's decision.
