The Division forwarded your letter to the Operator and the United <br />States Fores[ Service. The following comments and/or changes were made to the permit application; <br />]. 6.3.4(1)(c)(iii). Pase 2 of Exhibit D- The operator revised the seed mixture to eliminate Climax <br />Timothy and replace Smooth Brome with Mountain Brome. <br />2. 6.3.4(1)(8. Estimate of Actual Cost of Reclamation The Division estimated the cost [o reclaim the <br />White Banks Mine based on the anticipated worst case disturbance and the approved reclamation <br />plan. The Division estimates a cost of $l 1,500.00. Please note that the bond was calculated on the <br />seed mixture proposed by the applicant, and approved by the landowner (US Forest Service). A <br />copy of the Forest Service letter is attached. Therefore, the Division estimated a cost for <br />transplanting only shrubs and not trees. A cost for transplanting tublings and a fertilizer pellet were <br />included in the estimate. The specified number of shrubs will need to be established on the <br />reclaimed site in order for the bond to be released in its entirety. <br />3. Please be aware that the Division does not include a cost for inflation in the bond estimate because it <br />is not mandated by the Colorado Mined Land Reclamation Act of C.R.S. 34-32-101. However <br />C.R.S. 34-32-117(4)((b)(I) states that in any single year during the life of a permit, the amount of <br />required financial warranties shall not exceed the estimated cost of fully reclaiming all lands to be <br />affected. In addition, C.R.S. 34-32-I l7(4)(c)(i) states that the Board may from time to time for good <br />cause shown, increase or decrease the amount and duration of required financial warranties to ensure <br />the financial warranty is adequate to achieve the approved reclamation plan. The adequacy of the <br />financial warranty is reviewed during the routine inspections conducted by the Division. <br />
