2. Term: 2_1 the term of this Lease s..^.a l'_ be ten (10) • !ears commencing on i !~ ~ ~ ~, h. 1982 and ending on •,)~;~~' °~~ 1992, inclusive. 2_2 If, at the expiration of the term of this Lease, LESSEE shall have fully performed all of its teens and conditions and obligations under the Lease, LESSEE shall have the option to extend this Lease for an additional ten (10J year term. The option shall be exercised by LESSEE giving written notice to LESSOR of its intention to extend the term at least ninety (90) days prior to the expiration of the Lease term in subparagraph 2.1 hereof. 2_3 If LESSEE exercises its option to extend the lease term, a new lease agreement for the additional term shall be executed setting out mutually agreeable covenants, con- ditions and rental; provided, however, that, if the parties are unable to mutually agree to such covenants, conditions and rental prior to the expiration of the initial teem, the option exercise • ~ shall be deemed cancelled and of no effect whatsoever. 3. Rental. LESSEE shall pay rental for the Premises as specified on Exhibit C attached hereto. Any delincuency in said rental payment (subject to the notice requitement of Section 9.1 herein) shall be considered a delinquency in rental and a breach of this Lease. 4. Use and Possession. Subject to the provisions hereof, LESSEE shall have exclusive possession of the Premises during the term hereof for any purposes directly related to or connected with its coal mining operations, including but not limited to: construction, operation and maintenance of struc- tures, equipment or facilities; stockpiling and storing of coal; and the usage of the roads for the haulage of coal and any necess- ary upgrading of roads as required.
