THIS AGREEMENT made this 2 7 .d day of ~~~ ~ %' 1962
by and between UNITED STATES STEEL CORPORATION, 600 Gran[ Street,
Pittsburgh, Pennsylvania 15230, a Delaware corporation duly
authorized to do business in Colorado ('LESSOR') and ATLA[JTIC
RICHFIELD COMPANY, 555 17th Street, Denver, Colorado 80202, a
Pennsylvania corporation duly authorized to do business in
Colorado ('LESSEE').
WZTNESSETH:
47HEREAS, LESSEE is engaged in coal mining operations on
. lands contiguous with properties of LESSOR in Gunnison County,
Colorado, and;
WHEREAS, LESSEE desires to lease certain surface lands
from LESSOR and LESSOR desires to lease those surface lands [o
LESSEE, as such lands (the 'Premises') are more particularly des-
cribed in Exhibits A and B attached hereto; and

ment containing mutually satisfactory terms and conditions appli-
cable to a lease between LESSOR and LESSEE of the Premises,
NOW THEREFORE,'in consideration of the mutual covenants
and conditions herein contained, the parties hereto, intending to
be legally bound, do hereby agree as follows:
1. Premises. LESSOR hereby leases to LESSEE the surface
lands in the Premises, reserving, however, in and to the LESSOR
the rights of access for ingress, egress and regress in, on, over,
under and across the Premises in connection with the mining,
transportation, cleaning and removal of coal on lands now c:+ned or
hereafter acquired by LESSOR, wits out unreasonably ante [feting
with LESSEE'S uses of the Premises pursuant hereto. This Lease is
also subject to any easements, covenants, conditions, agreements,
restrictions, rights-of-way or other encumbrances of record or
apparent from an examination of [he Premises.
