ISSUES TO BE CONSIDERED: <br /> <br />Issues to be considered are based on the pre-Hearing Order for the Bennett Sand & Gravel Pit #2 <br />dated July 16, 2001. <br />1. "Has the applicant provided an adequate reclamation plan addressing backfil[ing attd <br />grading, topsoiling, and revegelalion?" (Sections 34-32.5-116(4)(a),(b),(~, & (g)) <br />"To my knowledge there are two (2) different maps of the area being made available. <br />The map we received from Adams County ... I believe is the correct one." (Anderson, <br />6/30/01) <br />"there is going to be a lot of damage done to the ground by removing the sand and the <br />minerals along with it." (Anderson, 6/30!01) <br />"After that many years of (surface material/topsoil) being piled up and then try to return <br />to rangeland doe not sound feasible." (Anderson, 6/30/01) <br />Division Response -The Applicant has verified that the maps provided do correspond with the <br />legal description for the proposed 47.75 acre permit area. The maps sent by Adams County to <br />Mrs. Anderson should not be construed as the maps pertaining to the application for a mining <br />and reclamation permit from the State of Colorado, File No. M-2001-038. The Applicant will <br />backfill and grade overburen where appropriate and will practice contemporaneous reclamation <br />where feasible. Available topsoil will be salvaged and stockpiled for use in reclamation. The <br />Applicant has provided an adequate reclamation plan to backfill and grade disturbed slopes to a <br />configuration of no greater than 3V:1H, replace available topsoil, and revegetate with a rangeland <br />grass seed mix. <br />2. "Will the operatiot: tninimize disturbances to the hydrologic balance of the alluvial <br />aquifers in t{te Kiowa-Bijou or Lost Creek Basit:s?" (Sectior: 34-32.5-116(4)(h)) <br />"We strongly oppose any mining operations which will possibly affect allrvial aquifers in <br />the Kiowa-Bijou or Lost Creek Basics. " (Sm4ter, 5/7/Ol ) <br />
