PARTI
Page No. 5
Permit No. COG-BSOOOC~
B. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
• 1. Effluent Limitations
b. Post-Minine Outfalls
Post-mining limitations may apply to outfalls serving surface azeas, which have been resumed to the required contour and on whit}, ;
revegetaticn (specifically, seeding or planting) work has commenced. The pemilttee may request consideration for change from'
active mining limitations to post-mining limitations when these conditions have been met.
POST-MINING PRIMARY LIMITATIONS
>~:`.,. ._r`r_.Parameter e? '•Applies only to drainag~ within the Colorado River Basin
'••Applies only to drainages directly about Chatfield Resmotr, Cherry Crttkk Reservoir, Dillon smov, or Upper Bear Creek
c. General Limitations -Active and Post-Mining Outfalls
1) There shall be no discharge of sanitary wastewaters from toilets or related facilities.
2) There shall be no discharge of floating solids or vistble foam in other than trace amounts.
3) There shall be no land application of wastewater other than for dust control.
4) No chemicals shall be added to the dischazge unless the Division grants specific approval
d. Burden of Proof Requirements
The pemlittee has the burden ofproof when requesting relief from total suspended solids (TSS), total iron, total manganese, and/or
settleable solids limitations, Relief shall be granted only when necessary and shall not be granted when the permittee has control
over the dischazge. The pennittee should endeavor to meet the primary limitations whenever posstble. The Division shall have final
authority in determining whether relief is granted.
1) For rainfall, to waive TSS, total iron, and total manganese limitations, it is necessary to demonstrate that dischazge occurred
within 48 hours after measurable precipitation has stopped. To waive settleable solids limitations, it is necessary to prove that
dischazge occurred within 48 hours after precipitation greater than the 10-yeaz, 24-hour event has stopped.
2) For snowmelt, to waive TSS, total iron, and total manganese limitations, it is necessary to demonstrate that dischazge occurred
within 48 hours aRer pond inflow has stopped. To waive settleable solids limitations, it is necessary to prove that discharge
occurred within 48 hours after pond inflow volume greater than the 10-yeaz, 24-hour event has stopped.
• The Division shall determine the adequacy of proof. As part of this determination, the Division shall evaluate whether the permittee
could have controlled the dischazge in such a manner that primary limitations could have been met. All manual dewatering ofponds
that are equipped with automatic dewatering systems must meet TSS, total iron, and total manganese limitations. If a pond has only
manual dewatering capability, relief is available only to the extent requtred to regain necessary stability and capacity.
See Part I.C. for Definitions
