Kenney <br />abstaining, that the Planning Commission recommend to the Boarcl of <br />County Commissioners that the Frei Rezoning Request (Case N132) <br />be approved with the following conditions: <br />1) that the perimeter of the floor be designated as a building <br />envelope within which X11 buildings and operations will be <br />confined except mining and reve etation; <br />2) that an indication of the intent to provide employee parking <br />across Hightiaay 6 on the Texaco Placer be indicated on the <br />Official Development Plan; <br />3) that the fact that the legal descriptions on the plat which <br />describe the property as two parcels is intended only for <br />zoning purposes and does not accomplish approval of division <br />of the property into those two parcels for purposes of <br />conveyance be included on the plat; <br />4) that the revegetation of the property be inspected by the <br />Colorado Division of {4ildlife once yearly for five years and <br />thereafter once each five years, or more often at the discretion <br />or the Division, to assess need for further County revieLa; <br />S) that a platting condition be added to prohibit the operator or <br />property owner from interfering with the existing jeep trail <br />or the existing streambed to the southwest of the property or <br />the existing drainage system; and <br />6) that once the Official Development Plan is presented in its final <br />form, the Commission delegates to Peter Kenney, Chairman of <br />tiLe Commission, the authority to sign the plat following his <br />confirmation of compliance with the above listed stipulations. <br />Dlr. Kenney resumed chairmanship of the meeting. <br />REQUEST TO DIVIDE LAND (Case b1-83-AX <br />Mr. {Peav~' reported that contact with the Department of Highways <br />resulted i confirmation that at the time of the condemnation of <br />right-of-way or I-70, no compensation was paid to,:{he then property <br />owners to comp'1?nsate for damages, thereby indicating that there was <br />no presumption of.~any condemnation of future us~'for t1Le portion of <br />the property remaiPning south of the highway. , <br />'.. <br />In response to a question from Dlr. hall, i`tr. {Veaver explained that <br />t1Le Robertsons have approached the Board of Adjustment regarding a <br />possible variance for this',property to'build on less than one acre <br />and the Board Baas unable to 'identify any potential problems with <br />regard to granting such a variance'.
