Oxbow Mining, LLC <br />Permit No. 03PO1037 <br />Initial Approval Colorado Department of Public Health and Environment <br />page 2 Air Pollution Control Division <br />Particulate Matter: 4.69 tons per month and 56.26 tons per year. <br />PM10 (Particulate Matter<10 µm): 95.76 pounds per day, 1.46 tons per month, and <br />17.48 tons per year <br />Nitrogen Oxides: 14.80 tons per year. <br />Carbon Monoxide: 3.19 tons per year. <br />During the first twelve (12) months of operation, compliance with the daily, monthly and yearly <br />emission limitations shall be required. After the first twelve (12) months of operation, compliance <br />with only the daily and yearly limitations shall be required. Compliance with the yearly emission <br />limits shalt be determined on a rolling twelve (12) month total. <br />The permit holder shall calculate emissions monthly and keep a compliance record on site in <br />order to demonstrate compliance with the above emission limitations. After the first twelve (12) <br />months of operation, the permit holder shall calculate annual emissions by the end of each month. <br />Anrtuat emissions shall be calculated based ort the previous twelve (12) months' emission data. <br />These calculated annual emissions shall be used to demonstrate compliance with the yearly <br />emission limit listed above. <br />Note: The applicant is not required to calculate daily emissions unless so requested by the <br />Division. <br />6. This source shall be limited to a maximum processing rate as listed below and all other activities, <br />operational rates and numbers of equipment as stated in the application. Monthly records of the <br />actual processing rate sha!! be maintained by the applicant and made available to the Division for <br />inspection upon request. (Reference: Regulation 3, Part B, III.A.4) <br />Screening of coal shall not exceed 9600 tons per day 3,504,000 tons per year. <br />Compliance with the yearly production limits shall be determined on a rolling twelve (12) month <br />total. <br />7. Spray bars shall be used if material moisture content is insufficient to control particulate <br />emissions. <br />8. Each time this equipment is moved to a new location within the State of Colorado the owner or <br />operator shall file a Relocation Notice. Such notice shall be received by the Division at least ten <br />(10) days prior to the change in location. The Relocation Notice shall include a facility emission <br />inventory of all emission units at the site. (Reference: Regulation 3, Part A,II.C.1.f and Part <br />B.IV.E.) <br />9. A Revised Air Pollutant Emission Notice (APEN) shall be filed: (Reference: Reg. 3, Part A,II.C) <br />a. Annually whenever a significant increase in emissions occurs as follows: <br />For any criteria pollutant: <br />For sources emitting less than 100 tons per year, a change in actual emissions of five <br />tons per year or more, above the level reported on the last APEN submitted; or <br />For any non-criteria reportable pollutant: <br />777/2223/001 ver. 2/00 <br />
