i <br />STATE OF COLORADO <br />COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT a cO~b <br />AIR POLLUTION CONTROL DIVISION y ~ <br />TELEPHONE: (303) 692-3150 : r` <br />31876 ~ <br />CONSTRUCTION PERMIT <br />PERMIT No: 03P01037 <br />DATE ISSUED: MAY 3, 2004 <br />ISSUED To: Oxbow Mining, LLC <br />INITIAL APPROVAL <br />THE SOURCE TO WHICH THIS PERMIT APPLIES IS DESCRIBED AND LOCATED AS FOLLOWS: <br />Portable coal screen initially located at the underground coal mine know as the Elk Creek <br />Mine located immediately north of Somerset, Gunnison County, Colorado. <br />THE SPECIFIC EQUIPMENT OR ACTIVITY SUBJECT TO THIS PERMIT INCLUDES THE FOLLOWING: <br />Terex Power Screen Chieftain 1800 with Deutz BF4M 101X, 109 hp, diesel generator. <br />THIS PERMIT IS GRANTED SUBJECT TO ALL RULES AND REGULATIONS OF THE COLORADO AIR <br />QUALITY CONTROL COMMISSION AND THE COLORADO AIR POLLUTION PREVENTION AND <br />CONTROL ACTC.R.S. (25-7-101 et se , TO THOSE GENERAL TERMS AND CONDITIONS INCLUDED <br />IN THIS DOCUMENT AND THE FOLLOWING SPECIFIC TERMS AND CONDITIONS: <br />1. Visible emissions shall not exceed twenty percent (20%) opacity during normal operation of the <br />source. During periods of startup, process modification, or adjustment of conVol equipment <br />visible emissions shall not exceed 30% opacity for more than six minutes in any sixty consecutive <br />minutes. Opacity shall be measured by EPA Method 9. (Reference: Regulation 1, Section <br />ILA.1.84.) <br />2. The permit number shall be marked on the subject equipment for ease of identification. <br />(Reference: Reg. 3, Part B, IV.E.) (State only enforceable) <br />3. The serial number of the subject equipment shall be provided to the Division prior to Final <br />Approval. (Reference: Reg. 3, Part B, IV.E.) <br />4. Construction of this source must commence within 18 months of initial approval permit issuance <br />date or within 18 months of date on which such construction or activity was scheduled to <br />commence as stated in the application. If commencement does not occur within the stated time <br />the permit will expire on NODElIBER 3, 2005 (See General Condition <br />No. 6., Item 1.) (Reference:Regulation 3, Part B, IV.G.4.) <br />5. Emissions of air pollutants shall not exceed the following limitations (as calculated in the Division's <br />preliminary analysis). Compliance with the annual limits shall be determined on a rolling (12) <br />month total. By the end of each month a new twelve month total is calculated based on the <br />previous twelve months' data. The permit holder shall calculate monthly emissions and keep a <br />compliance record on site for Division review. (Reference: Regulation 3, Part B, III.A.4) <br />777/2223/001 ver. 2/00 <br />
