(LRM), for the use of <br />leased C-BT Project water in a 2007 SWSP as allowed by the Interim Rule on the Use of <br />Colorado-Bif Thompson Pro'ect Water in Substitute Water Sugp,~y Plans and Plans for <br />Aummentation adopted May~13, 2005, by the Northerh Colorado Water Conservancy District <br />(Nor[bern Water) Board of birectors. The following Mif±+*na^aes the key issues for this approval <br />and further requirements on the use of leased C-BT Project water in the 2007 SWSP. <br />Northern 'Water staff has reviewed your request letter dated February 6, 2007. The LRM 2007 <br />SWSP is for the augmentation of gravel pit depletions from the Larimer Pit (1vII.R No. M-74- <br />069). This gravel pit is within Northern Water botmdaries. Therefore, LRM meets the <br />req~i~*~~+t that C-BT water be used only to offset depletions that are the result of a beneficial <br />use of water within Northern Water boundaries. <br />The intent of the hrterim Rule is to allow the annual temporary lease. of C BT in annual SWSP's <br />.-..---ipplt-'d~$g'~18~85~9^ `p~aV61~t5~ 7t 9~0421f~ ~Mi•$~~ b0~/CSyt9~39F.•9~•r awr.+Ti-'pia SW$P fOr 2 <br />given structure at a specific location (i.e., the Latimer Pit) sbatl not exceed a total of $ve years. <br />For its 2007 SWSP, LRM leased 43.0 acre feet for March 1, 2007, tluough October 31, 2007, <br />and 24.0 acre-feet for November 1, 2007, through February 29, 2008, of C-BT Project water <br />from the City of Loveland, a Class B municipal C-BT Account Entity. Per the Interim Rule, the <br />net yield of C-BT Project water leased from a municipal Account Entity for use in a SWSP is <br />50 percent of the net C-BT Project water delivered to the appropriate river reach for depletion <br />replacement, aad this 50 percent factor was appropriately applied in LRM's 2007 SWSP <br />Accounting Table. <br />LRivI must provide Northern Water with an updated monthly Accounting Table showing C-BT <br />Project water releases made fox the 2007 LRM's SWSP, which ends February 29, 2008, This <br />updated accounting should list the actual river conveyance shrink assigned by the Division <br />Engineer, along with a running total of actual and projected C-BT Project water released for <br />
