<br />Stormwater: Stormwater: Stormwater from inactive coal mining operations that has been contaminated by contact with an
<br />over ur en, raw material, intermediate products, finished products, byproducts or waste products located on the site of such
<br />operations is required to be covered by a Colorado Discharge Permit System (CDPS) ermit in order to be discharged to State
<br />waters. This covera e may be obtained under either a CDPS Industrial Wastewater Discharge Permit or a CDPS Stormwater
<br />Discharge Permit. ~or facilities that have individual CDPS permits for discharge of rocess water, any applicable Stormwater
<br />provisions can then 6e included in individual CDPSpermits. The individual permit Jor discharge o~process water for the Bear
<br />Mme No. 3, CDPS permit (Na. CO-0044377), eontams Stormwater provisions that differ from the provisions of the rocess
<br />water portion, and are laid out in Part ID.2 of the permit. Under the terms of the combined individual permit ( 0-0044377),
<br />Bear Coal Company will be authorized to discharge Stormwater associated with industrial activity into waters of the State of
<br />Colorado.
<br />The terms and conditions of this permit, as related to Stormwater discharges, include:
<br />a. Se re anon o Stormwater Dischar es: All dischargges covered by the Stormwater portion of this permit shall be composed
<br />entire y o Stormwater except as iscussed at Partl.D.2.d.ii ofthe permit).
<br />Stormwater which mixes with pprocess water is subject to process water controls. Discharges from sources other than
<br />Stormwater must be addressed by the process water controls in this CDPS permit.
<br />b. Stormwater Management Plans (SWMPs): The purpose of a SWMP is to identify possible pollutant sources that may
<br />contaminate Stormwater an to set out est management practices that, when implemented, will reduce or eliminate any
<br />possible water quality impacts.
<br />A SWMP must be maintained for the Bear Mine No. 3 in accordance with good engineering practices. The plan identifies
<br />potential sources ofpollution which may reasonably be expected to affect the quality of storniwater discharges associated
<br />:vith industrial achvily. In addition, the play, describes and ensures tF.e implementattar. ofpractices which are to be used to
<br />reduce the pollutants in Stormwater discharges associated with industrial activiry at the facility, and assures compliance
<br />with the terms and conditions of this permit. Bear Coal Company must implement the provisions o the SWMP as a
<br />condition ojthis permit. Contents and requirements of the SWMP are discussed in the permit at Part LD.~b
<br />c. Comprehensive Facili Ins ections: The permittee will be required to make a thorough inspection of their Stormwater
<br />management system, at east twice per year ((in the spring and fall). These inspections must be documented and
<br />summarized in the annual report. (See Part LD.l.e ojthe permit.)
<br />d. Annual~Re ort: The permittee will be required to submit an annual report, covering January /through December 31 of
<br />each year, on the overall compliance with the SWMP. The Annual Report will be due to the Division on or before February
<br />15 of the following year (see Part LD.2.g of the permit).
<br />4. Economic Reasonableness Evaluation: Section 25-8-503(8) of the revised (June 1985) Colorado Water ualit Control Act

<br />The Colorado Dischar e Per:rt S-~steni Re ulations Regulation No. 61, further define this reguirzment under 51.11 and state.•

<br />a. Anew permit is issued where the discharge was not in existence during ojthe classification and standards rulemaking, or
<br />b. In the case of a continuing discharge, additional information or 'actors have emerged that were not anticipated or
<br />considered at the time ofthe classification and standards rulemaking. '
<br />The evaluation far this permit shows that the Water puality Control Commission, during their proceedings to adopt the
<br />Classifications and Numeric Standards (or Gunnison and-Lower Dolores River Basins considered economic reasonableness.
