COLORADO DEPARTMENT OF PUBLlC HEALTHAND ENVIRONMENT, Wnter Qualiry Control Division
Rationale -Page 5, Permit Na. CO-0044377
Stormwater: Stormwater: Stormwater from inactive coal mining operations that has been contaminated by contact with an
over ur en, raw material, intermediate products, finished products, byproducts or waste products located on the site of such
operations is required to be covered by a Colorado Discharge Permit System (CDPS) ermit in order to be discharged to State
waters. This covera e may be obtained under either a CDPS Industrial Wastewater Discharge Permit or a CDPS Stormwater
Discharge Permit. ~or facilities that have individual CDPS permits for discharge of rocess water, any applicable Stormwater
provisions can then 6e included in individual CDPSpermits. The individual permit Jor discharge o~process water for the Bear
Mme No. 3, CDPS permit (Na. CO-0044377), eontams Stormwater provisions that differ from the provisions of the rocess
water portion, and are laid out in Part ID.2 of the permit. Stormwater Management Plans (SWMPs): The purpose of a SWMP is to identify possible pollutant sources that may
contaminate Stormwater an to set out est management practices that, when implemented, will reduce or eliminate any
possible water quality impacts.
A SWMP must be maintained for the Bear Mine No. 3 in accordance with good engineering practices. The plan identifies
potential sources ofpollution which may reasonably be expected to affect the quality of storniwater discharges associated
:vith industrial achvily. In addition, the play, describes and ensures tF.e implementattar. ofpractices which are to be used to
reduce the pollutants in Stormwater discharges associated with industrial activiry at the facility, and assures compliance
with the terms and conditions of this permit. Anew permit is issued where the discharge was not in existence during ojthe classification and standards rulemaking, or
b. In the case of a continuing discharge, additional information or 'actors have emerged that were not anticipated or
considered at the time ofthe classification and standards rulemaking. '
The evaluation far this permit shows that the Water puality Control Commission, during their proceedings to adopt the
Classifications and Numeric Standards (or Gunnison and-Lower Dolores River Basins considered economic reasonableness.
Fur!hermere, this is not a new dischar~~r end ne new in orma!ion has been presen!ed re~ardin~ the classiJ~t'cations and
standards. Therefore, the water quality standard-based e uent limitations of this permit ar°e determined to be reasonably
related to the economic, environmental, public health and ever im acts to the public and affected persons and are in
jartherarce of the policies set forth in Sections 25-8-102 and 10~ I,~he permittee disagrees with ±hu;indirg, pursuant to
61.11(b)(ii) of the Colorado Dischar e Permit S stem Re ulations the permittee should submit all pertinent information to the
Division durng the pu is notice perto .
B.
