The historic consumptive use available from the Buffalo Canal shares (3,610 acre-feet) <br />will be sufficient in quantity to augment the projected maximum water use at the site <br />(1822 acre-feet). Approximately 761 shares of the Buffalo Canal will be required for an <br />augmentation plan for the operation at the last stage of mining. <br />Surroundln~ Water Rlp)7ts <br />A map and tabulation of surrounding water rights and well permits are attached with this <br />exhibit. Water rights and well permits for shallow wells are identified which lie within <br />approximately 1/2 mile of the subject property. The river serves as a natural hydrologic <br />barrier and therefore no wells and water rights which lie on the south side of the river <br />were identified. <br />There are no surface diversions from the Arkansas River within 1/2 mile. However there <br />are several wells located in the area of the mine site. Wells which are owned by <br />Midwestern Resources are not plotted on the well/water rights map. <br />Due to the fact that the site will be wet mined there will be no drawdown of the water <br />table in the vicinity of the mine and in turn no well rights will be injured. <br />Dlscherye Permit <br />The proposed mining plan does not require a discharge to the stream system. <br />404 Dredge and FIII Permit <br />No wetlands were found at the site during a field investigation. The present mining plan <br />does not intend to place any fill in any known wetlands and as such will not require a 404 <br />permit. <br />Stormwater Maneyement Permit <br />A stormwater management plan will be developed for the site and a Stormwater permit <br />will be acquired from the Colorado Department of Health. <br />G-4 <br />
