Ndan, MD, MPH <br />Cxeavwc Dirttwr <br />The Division has received your request for inactivation of your <br />certification under the Construction Aggregate General Permit. <br />Before proceeding with the inactivation, you should be aware that <br />the Environmental Protection Agency finalized Stormwater <br />regulations on November 16, 1990. A copy of the regulation is <br />enclosed. The regulations require facilities such as yours to be <br />covered under a NPDES (CDPS In Colorado) for Stormwater discharges <br />until such time as the Mined Land Reclamation Division determines <br />the site is reclaimed. The Water Quality Control Division has <br />modified the Construction Aggregate General Permit to cover <br />Stormwater discharges, therefore continued coverage under this <br />permit may be desirable. To ensure that we are not inactivating <br />permits which are subject to the Stormwater regulation, we are <br />asking that you suply us with verification that you have reclaimed <br />the site and have received from MLRD a "Letter of Release".
