The applicant has identifted the following structures as being within 200 feet of the mine <br />limits: ponds, roads, houses, utility lines, and irrigation ditches. A stability analysis was <br />provided for all such sttuctures except for the irrigation ditches. The stability analysis does not <br />consider the irrigation ditches because "agreements between the mining company and ditch <br />companies will be reached prior to mining". Until such written agreements (as specified in Rule <br />6.4.19) can be provided to the Division, the operator will need to commit to a minimum setback <br />distance of at least two hundred (200) feet from any ditch that is within 200 feet of the affected <br />land. The applicant has identified on page 22 and on the Mine Plan Map five (5) irrigation <br />ditches of concern. Please respond. Also, we have attached stability analysis review corrunents <br />from Allen Sorenson of the Division and comments received from the Niwot Ditch Company. <br />Please respond. <br />Once again, I will look forwazd to your response on or before May 18, 2001 to allow adequate <br />time for review before the June 11, 2001 decision date. Rule 1.8.1 states that changes and <br />additions to the permit application must be filed with the Division and the County Clerk and <br />Recorder.
