<br />of the settling pond(s) and discharge point(s) and to include a representative cross section of the <br />pit excavation and dewatering trench during a maximum disturbance scenario. <br />4. The applicant states on page 13 that overburden will be used in reclaiming and sloping the <br />shore and that excess overburden will be sold. In conformance with Rule 6.4.4(a), please clarify <br />that the maximum volume of overburden to be stockpiled at any one time will be 61,340 cubic <br />yards. (The reclamation cost as presented in Exhibit L is based on a maximum disturbance at any <br />one time of 51 acres and backfilling and regrading of 61,340 cubic yards. Therefore, the operator <br />should be awaze that any additional volume of overburden stored on site will create an additional <br />reclamation liability and may be considered by the Division to be a compliance issue). <br />5. The maximum disturbance to be expected at any one time, as defined in Exhibit L, will be 51 <br />acres and includes the Phase 6 area as well as shoreline reclamation in Phase 5. The applicant <br />indicates on page 14 that in addition to the processing site, the area disturbed during any phase of <br />mining will be limited to either one individual pod or portions of two pods based on mining <br />activity. In consideration of Rule 6.4.4(e)(ii) the Division prefers that the operator be bonded for <br />a maximum disturbance of both Phases 5 & 6, plus the processing site. These criteria provide the <br />operator greater flexibility in the allowable disturbance and appear to be more manageable for <br />both the operator as well as the Division. Please comment. <br />6.4.5 EXI3IBIT E -Reclamation Plan <br />6. The applicant states on page 15 that the wash basins will be allowed to fill with silts to an <br />elevation slightly above the groundwater level. In conformance with Rule 6.4.5(2)(e), please <br />define how and when the baseline groundwater levels will be determined. (The groundwater <br />levels used or anticipated at the time of reclamation should correlate with baseline groundwater <br />levels determined for that same time of yeaz, ie: Fall-Fall, Spring-Spring, Summer-Summer, <br />rather than Spring-Fall or Spring-Summer). Please respond. <br />7. The reclamation plan map indicates that a IS-acre portion of Area 6 will be considered for <br />backfilling with clean fill or will be reclaimed to a pond. Please clarify the intended reclamation <br />for this 15-acre azea. Please note that prior to backfilling with clean fill, the applicant will need <br />to demonstrate compliance with the requirements of Rule 3.1.5(9). (see attached copy). <br />8. The applicant has stated on page 19 that upon completion of the mining and shoreline <br />reclamation, Aggregate will work with the landowner to install additional plantings. These <br />native and adapted trees and shrubs will enhance the wildlife habitat by providing food and cover <br />for resident and migratory wildlife. The applicant has also provided on pages 19 & 20 a list of <br />potential tree and shrub species that may be planted. In conformance with Rules 6.4.5(2)(d) & <br />6.4.5(2)(f)(ii), please specify the approximate number(s) and size (diameter) of trees and/or <br />shrubs to be established during final reclamation. in addition, the Division requests that the <br />applicant provide on a revised copy of the Reclamation Plan Map the approximate location of <br />where such trees and/or shrubs will occur. Please address. <br />
