Health and Safet~~ • <br />The Hayden Gulch loadou[ facility falls under the Federal Mine Safety and Health Act of <br />1977, PL 95-164. The Mine Safety and Health Administration, the enforcement agency, is a <br />part of the U. S. Department of Labor. MSHA is required to inspect and enforce [he Code of <br />Federal Regulations Title 30, which includes Parts 4B, 50, 71 and 77. <br />Pact 49 sets forth the requirements for obtaining approval of training programs and <br />specifies the type of training including new employee orientation £or non-experienced <br />miners, orientation of newly employed experienced miners, annual refresher course for all <br />miners, hazard training for non-employees coming onto mine property, and task training for <br />employees who are assigned new jobs temporarily. <br />Part 50 requires operators to file reports pertaining to accidents, occupational injuries <br />and occupational illnesses, as well as employment and coal production data, with MSHA, and <br />requires operators to maintain copies of reports at relevant mine offices. The purpose of <br />this Part is to implement MSHA's authority to investigate, and to obtain and utilize <br />information pertaining to accident a, injuries, and illnesses occurring and originating in <br />mines. <br />Part 71 of CFR 30 sets forth standards for dust, noise, sanitary toilet facilities, change <br />rooms, sanitary toilet facilities at sur Este work areas, and drinking water. These <br />standards are ap~~lled out in terms of the concentration of respirable duet to which a miner <br />can be exposed sad the general requirements for noise level expoeuse. The size, location, <br />and number of t:ae change rcome, sanitary flush toilets, portable toilets, showers, hand <br />lavatories, and lockers are based on the number of employees. An adequate supply of <br />drinking water and cups shall be provided in marked disinfected containers. <br />Part 77 deals with the mandatory safety standards. This Part ie divided into 20 subparts <br />with sections unier each subpart.
