STATE HIGHWAY ACCESS PERMIT #399057 <br />Issued to Bowies Resources, Inc. <br />TERMS & CONDITIONS (cont'd) <br />June 7, 1999 <br />noted on the design plans. Thr Colorado Registered Professional Engineer shall st}al dte.plans in accordance with <br />CRS 12-?5-1,17 m addition on the first page of the design plans that the following ote is required: <br />"This design is in full compliance \Vith Section 4 Of the State Hiehway Acce s <br />Code. 2 CCR 601-1 except for the following approved variances:' <br />Note: A~,L plans must be submitted on I1" x 17" sheets at a minimum scale <br />I" = 20', No other plan sheet sizes are authorized. Location drawings ma <br />he submlued at other scales as approved. <br />24. All construction work must be under the direction of a Colorado Registered Profe sional Engineer and upon <br />completion o~ the work, that responsible Engineer shall suborn an "As Built" plan ,showing in detail all approved <br />construction changes, modifications and revisions. The "As Built" Plans must be Baled in accordance with CRS <br />12-25-117. <br />25. It shall he [het responsibility of the Permiuee to verify the location of the exis[ing tilities and notify all utility <br />owners or opi:rators of any work that might involve utilities within the State High 'ay right-of-way. Any work <br />necessary to protect existing permitted utilities, such as an encasement will be the esponsibiliq• o(the Permiuee. <br />Any damage pr disruption to an}• utilities during the construction shall he the Pern ittee's responsibility and shsll <br />be repaired of replaced at no cost to the Department. <br />26. Any damage to any present highway facilities including traffic control devices sha I be repaired immediately at no <br />cost to the Department and prior to continuing other work. Any mud or other mat rial tracked or otherwise <br />deposited on the roadway shall be removed daily or as ordered by the Depar[ment nspector. <br />27. Areas of roadway and/or right-of-way disturbed during this installation shall be re cored to their original <br />conditions, td insure proper strength. drainage and erosion control. <br />28. Any incomplete construction activity on the State Highway that must be left Quern ght, shall be barricaded and <br />signed in accordance with the Manual on Uniform Traffic Control Devices and of er applicable standards. <br />29. Open cuts, which are 6 inches in depth, within 30 feet of the edge of the State Hig way traveled way, will not be <br />left open at n~ght, on weekends, or od holidays. <br />30. No more tha 6 feet of trench areas shall be opened at any one time. Open wench sand other excavations within <br />the Slate Hig~way right-of-way shall be backfilled and/or paved before 3:30 P.M. f each working day or be <br />protected in alccordance with the M.U.T.C.D. ' <br />31. The area around the new work shall be well graded to drain, top soiled, fertilized, ulched and re-seeded in <br />accordance wlith the Department standard specifications. <br />32. When it is necessary to remove any highway right-of-way fence, the posts on Bich r side of the access entrance <br />shall be secut{ely braced with approved end posts and in conformance with the De anment's M-607-I standard. <br />before the fence is cut, to prevent slacking of the remaining fence. All posts and ire removed shall be returned to <br />the Department. <br />33. All excavations for utility lines, culverts, wenches or tunnels shall meet the requirements of the Occupational, <br />Safety and Htalth Administration (OSHA), Colorado Industrial Commission, Col rado Division of Mines or the <br />Colorado Department of Transportation, whichever applies. <br />34. All work that, requires traffic control shall be supervised b}' a registered profession I traffic engineer or by a traffic <br />control supert+isor certified by the American Traffic Safety Services Association ( TSSA) or the Colorado <br />Contractors gssociation (CCA). When Flagging personnel are required, the contra for in accordance with the <br />Department standards shall certify them. <br />35.
