_ _.-~ <br />• i <br />Ms. Heidi Hirsh - 2 - February 15, 1985 <br />Exhibit M - Local Government Approval <br />During our review of the February 4, 1985 Resolution CC-85-144 issued by the <br />Jefferson County Board of Commissioners for this site, we noticed a number of <br />references to a "site plan review". Being unclear as to what this means, we <br />contacted Paul Banks with Jefferson County. Mr. Banks informed us that this <br />"site plan review" was a secondary process in which more detailed information <br />about this site has to be submitted. While an approval was granted, Mr. Banks <br />stated it was really a "conditional" approval, since all of the County zoning <br />concerns would not be met until after the Commissioners had approved the "site <br />plan review". Based on this conversation (which is being followed up in <br />writing by Mr. Banks), we do not believe you have "Jefferson County approval" <br />as specified in your adequcy response letter. Therefore, we believe C. Ryan & <br />Son should ask for a Board continuance until all County zoning regulations <br />have been met and a total, non-conditional approval is given by the <br />Commissioners to avoid problems with CRS 34-32-115(4)(e). <br />Other <br />After reviewing the certified mail receipts and the return receipts, the <br />following concerns were raised: <br />The Denver Water Board (Mr. Bob Panesi) was notified of this <br />application; however, we cannot find the Denver Water Board as either <br />the landowner or an adjacent landowner on Sheet 1 of 7. Please specify <br />the relationship of the Denver Water Board to this operation. <br />12.1, The First National Bank of Denver has been identified as landowner #1 <br />~-_f' on Sheet 1 of 7; however, we can not find any receipt that they have <br />been notified. Please submit documentation of notification. <br />3. Delbert Weidenhamer, et al., has been identified as landowner #13 on <br />Sheet 1 of 7; however, we cannot find any receipt that they have been <br />notified. Please submit documentation of notification. <br />Susan M. Lindsay, who is identified as landowner #7 on Sheet 1 of 7, <br />was sent notification of this proposed mining activity. The return <br />receipt was returned unsigned since she has deceased. While it is true <br />an attempt has been made to notify the landowner identified as #7 on <br />Sheet 1 of 7, in reality, they still do not know of the proposed <br />activities, pursuant to CRS 34-32-101 et seq. Therefore, the estate of <br />Susan M. Lindsay, if in fact they still own the land, or whomever <br />bought the land from the estate of Susan M.
