<br />WHEREAS, Rocky Mountain Rock Products Co .d esires Co conduct a(n) open mining
<br />operation, known as Deec Creek Qua cry ~rnc. for the purpose of extracting open
<br />mined granite and
<br />JvH1EREAS, on January 7, 1980, Rocky Mountain Rock Products Co., Inc. "FILED" an
<br />applicacion,a reclamation plan and map, and the required fee, as required by Lau; and
<br />lT}lEREAS, on May 29, 19 80 the hlined Land Reclamation Board approved
<br />Rocky Mountain Rock Products C'o., application and set bond; and
<br />fnc.
<br />.. [,1HEREAS, on June 30 19 80,~the `fined Land Reclamation Hoard accepted
<br />surety submitted by Rocky Mountain Rock Products Co., lnc. and such date shall be
<br />considered the date of iss u:rnce of the per aril and Lhn anniversary ddtu Ir, r' all other
<br />purposes; and
<br />t1HEREaS, the dined Land Reclamation Board has made a finding, for the purposes
<br />of issuing this permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />`fined Land Reclamation act and all ao?licable local,••scate and
<br />Federal laws; and,
<br />?) the operation will not adversely affect Che stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred Eeet of the affected Land, except where there
<br />is an agreement between the operator and [he persons having an
<br />interest in the structure that dama;e to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in conformance with the requirements of C.R.S. 1973, 34-32-110, as
<br />amended (1976 Sess. Laws H.B. 106 0 ; and
<br />':1HEREAS, For the purposes of issuing this permit, the operator has made a
<br />satisfactory showing to the Beard that he will amoloy during and after his
<br />- ol-,en mining operations procedures reasonably designed to mini-dze
<br />as much as practicable the disruption from the open minin3 operations
<br />and will provide for the rehabilitation of the affected Land though the rehabilitation
<br />of plant cover, soil stability, water resources, and other measures appropriate to the
<br />subsequent beneficial use of such mined and reclaimed lands; and that in the event
<br />of the fai'-ace of his proposed reclamation plan, he :+i11 take whatever measures '.:nick
<br />na_v be necessarv in order to assure the success of reclamation of the lands af:ectad
<br />b;~ his opn_n mining operations; and,
<br />'.dHEREAS, for the purposes of issuing this permit, a copy of [he application
<br />ap?roved by the `tined Land Reclamation Board cf the State of Colorado is attached
<br />to this permit and Cheraby becomes a part of the terms hereof.
<br />`JOSv, THEREFORE, pursuant to the authority se[ forth in the Colorado '4ined
<br />Land Reclamation Act, drticle 32 of Title J4, C.R.S. L973, as amended, (1976
