-4- EXHIBIT F - Proof of Compliance with Local Government Zoning In accordance with 34-32-115(4)(e), the Board must make a finding that the operation will oe in compliance witn local zoning or subdivision reyulations. You are not required to submit this information, but a submission would assist the Division's processing of the application. When the Uivision notifies the local government of the existence of this application, it will request information regardiny compliance with applicable local law. it is intended that operators .nay concurrently come into compliance with local requirements at the same time the Uivision is processing this application. E~eHIBIT G - Source of Legal Riyht-to-Enter This could oe a copy of the lease, deed, abstract of title, or current tax receipt. An acceptaole alternative would oe a statement acknowledged by a Notary Public that the operator has the legal right to enter the mine. EXHIBIT H - Reclamation Costs For a 11U permit, if the operator requests financial warranty to be less than j5,000.00, the operator must suD~nit facts to support such a request. Utnerwise, a financial warranty of ~S,000.UU will automatically oe set. For all 111 pennits, the financial warranty shall be ;2,500.00 per acre. EXHIBIT I - Terms of Governmental Contracts (111 Applications only) For Special 10-Day (111) pennits, the operator must su~xnit a copy of the contract or other proof that proves the necessity of a Special 10-day permit. The operator must also suo~nit evidence of the financial warranty provided under the governmental contract, if it was required. NOTICE PROCEDURES After the application is considered "filed" (pursuant to Rule l.l(lU) with the Mined Land Reclamation Division, notice procedures outlined in rule 3.2 and/or 4.2 must be followed.
