The submittal <br />sc^stinized included (1) a cover letter by Peabody Pe=n_ts <br />Supervisor, Gary W. Wendt, dated January 6, 1992, (2) a letter <br />from the Cclcradc Mine Land Reclamaticn Board tc the District <br />Cffice approvinc d teCnn=Cal revisicn application permi_ dated <br />December 27, 19°'_, (3) engineering documentation titled <br />"Attachment 13-a, Sedimentaticn Struc~ure 006, Phase II (As- <br />Built)", (4) certification of field density testing by Northwest <br />Ccicrado Consultants, Inc., during October 1989 when the original <br />structure was constructed titled "Addendum 3, Sedimentaticn Pond <br />OOn` - Phase II, As-Eui1t Certification", (5) certification by <br />Rcaa'_d J. Gehr{e, P.°., that Phase I- constnacticn durinc August <br />1391 conformed to the plans and specification ar,d to verify that <br />the as-bui-t drawings are correct as of November 2'_, 1991, and (6) <br />drawinc EXHI3IT 13-6, "POND 006 PEASE II", 12/11/91. <br />E_.amiraticn cf the submittal ir.dicatas that the principal and <br />emergency spillway were constructed to elevaticr.s 1.1 and 0.8 feet <br />higher that agreed upcn and stated in MSiiA Report D7237-W3038 <br />dated April 2'0, 1991. Since the facility dces not present a hazard as defined in <br />3G CFR, the dam does not fall under the jurisdiction o= 77.21'0 <br />
