The <br />impounding structure does not fall under MSHA's jurisdiction as to <br />size or hazard, as specified under 30 CFR 77.216. Enclosed for <br />your information is a copy of Report No. D7530-W3288 from the Mine <br />Waste and Construction Division of the Denver Safety and Health <br />Technology Center.
